NOTICE OF PUBLIC HEARING STATE OF INDIANA SS COUNTY OF KOSCIUSKO BEFORE THE BOARD OF COMMISSIONERS OF KOSCIUSKO COUNTY IN RE: THE PETITION OF JACOB A. MACKE AND KATHLEEN P. MACKE TO THE CITIZENS OF KOSCIUSKO COUNTY, INDIANA You are hereby notified that a petition has been filed with the Board of Commissioners of Kosciusko County, Indiana by Jacob A. Macke and Kathleen P. Macke, requesting the vacation by ordinance of a part of Blossom Lane in the Plat of Cherry Creek Manor, Kosciusko County, Indiana, and which part of Blossom Lane is described as follows, to wit: Part of Blossom Lane, adjacent to Lots Numbered 16 and 17 in the Plat of Cherry Creek Manor, as shown on Plat Book 13, page 27 in the records of Kosciusko County, Indiana, said part being more particularly described as follows: Commencing at a 5/8-inch iron pin capped "Walker" found at the Northwest corner of said Lot Number 17, thence S 89º - 17'E (Plat bearing and used as the basis of bearings for this description), on and along the North line of said Lot Number 17, also being on and along the South right-of-way line of said Blossom Lane, a distance of 79.52 feet to a corner of said Lot Number 17, said corner also being at the true point of beginning; thence Southeasterly on and along the Northeasterly line of said Lot Number 17, and on and along the North line of said Lot Number 16, also being on and along the Southwesterly right-of-way line of said Blossom Lane, being defined by a regular curve to the left, having a radius of 75.0 feet, an arc length of 44.21 feet (the chord of which bears S57º-58'-37"E for a distance of 43.57 feet) to a point on the North line of said Lot Number 16; thence Northwesterly, on a regular curve to the left, having a radius of 35.0 feet, an arc length of 28.17 feet (the chord of which bears N49º-11'-16"W for a distance of 27.42 feet), to the point of tangency; thence N72º-14'-49"W and tangent to said curve, a distance of 16.99 feet to the true point of beginning, containing 0.005 acres of land, more or less, subject to all legal drain easements and subject to all other easements of record. You are hereby notified that the Board of Commissioners of Kosciusko County, Indiana has set the above petition for hearing at 9:15 a.m., on January 18, 2011, at the Kosciusko County Board of Commissioners Meeting Room in the Kosciusko County Courthouse, 100 West Center Street, Warsaw, Indiana 46580. Any person may appear and be heard upon the petition at the time, date and place above scheduled for hearing and/or may send written comments or response to the Auditor of Kosciusko County, Indiana, prior to the above time and date set for hearing. After hearing, the petition may be granted, denied, or continued, and an ordinance may be introduced and passed according to law, providing for the vacation of said real estate.
