NOTICE OF PUBLIC HEARING NAPPANEE BOARD OF ZONING APPEALS The City of Nappanee Board of Zoning Appeals will hold a Public Hearing, Tuesday, March 10, 2009 at 6:00 pm in the Council Chambers of the City Municipal Building, 300 West Lincoln Street, Nappanee, Indiana. The purpose of this Hearing is to hear a variance request, #01-09-BZA, filed by Signtech Signs Services, Inc. PO Box 835 Goshen, Indiana 46528 on behalf of owners Hahn Investments, LLC 1203 E. Market St., Nappanee, Indiana and Wayside Inc. Nappanee, Indiana for purchaser Interra Credit Union 300 W. Lincoln Ave. Goshen, Indiana 46526. The request is for a variance from the Unified Zoning and Subdivision Control Ordinance to allow the construction of two ground signs located at 151 N. Oakland Ave., Nppanee, Indiana 46550. LEGAL DESCRIPTION OF THE PROPERTY: Tract 1: A part of the southwest quarter of the northwest quarter of section 32, township 35 north, range 5 east, more fully described as follows: Commencing in the center of the intersection of US Highway No. 6 and County Highway No. 7; thence North 225 feet in the center of County Highway No. 7 for a starting point; thence running east 300 feet; thence north 85 feet; thence west 300 feet; thence south in the center of County Highway No. 7, 85 feet to the place of beginning. also A part of the southwest quarter (SW 1/4) of the northwest quarter (SW 1/4) of section thirty-two (32), township thirty-five (35) north, range five (5) east, Union Township, Elkhart County, Indiana, more fully described as follows: Commencing in the center of the intersection of US Highway 6 and County Highway 6 and County Highway No. 7; thence north one hundred fifty (150) feet to the center of County Highway No. 7 for starting point; thence running east three hundred (300) feet; thence north seventy-five (75) feet; thence west three hundred (300) feet; thence south in the center of County Highway No. 7, seventy-five (75) feet to the place of beginning. Tract 2: A part of the northwest quarter of section 32, township 35 north, range 5 East, Union Township, Elkhart County, Indiana being more particularly described as follows: Assuming the south line of the northwest quarter of said section 32 to have a bearing of due east-west and beginning at the southwest corner of the northwest quarter of said section 32; thence north 00 degrees 15 minutes 40 seconds east along the west line of the northwest quarter of said section 32 and the centerline of County Road Number 7, a distance 150.00 feet; thence on a bearing of due east parallel with the south line of the northwest quarter of said section 32, a distance of 170.00 feet to a point; thence south 00 degrees 15 minutes 40 seconds west parallel with the west line of the northwest quarter of said section 32, a distance of 150.00 feet to the south line of the northwest quarter of said section 2; thence on a bearing of due west along the south line of the northwest quarter of said section 32, a distance of 170.00 feet to the point of beginning of the description. A copy of such proposal is on file in the office of the Zoning Administrator of the City of Nappanee, City Municipal Building, 300 W. Lincoln St., Nappanee, Indiana. Written objections that are filed with the office of the Zoning Administrator of the City of Nappanee before the hearing will be considered. All concerned citizens will be offered the right to speak and voice their comment at the Public Hearing may be continued from time to time as maybe found necessary.
