NOTICE OF PUBLIC HEARING NAPPANEE BOARD OF ZONING APPEALS The City of Nappanee Board of Zoning Appeals will hold a Public Hearing Tuesday, March 10, 2009 at 6:00 p.m. in the Council Chambers of the City Municipal Building, 300 W. Lincoln St, Nappanee, Indiana. The purpose of this Hearing is to hear a Special Exception request, #01-09-SU, filed by MapleNet Wireless, 4561 Pine Creek Rd. Elkhart, Indiana 46516 on behalf of owner Hahn Investments, LLC 1203 E. Market St, Nappanee, Indiana for purchaser Interra Credit Union 300 W. Lincoln Ave. Goshen. Indiana 46526. The request is for a Special Exception to allow the construction of a 120 foot tall wireless communication tower located at 151 N. Oakland Ave. Nappanee, Indiana 46550. LEGAL DESCRIPTION OF THE PROPERTY: Legal Description 151 N. Oakland Ave. A part of the Southwest Quarter (SW 1\4) of the Northwest Quarter (NW 1/4) of Section Thirty-two (32), Township Thirty-five (35) North, Range Five (5) East, Union Township, Elkhart County, Indiana more fully described as follows: Commencing in the intersection of U.S. Highway No. 6 and County Highway No. 7: thence North One: Hundred Fifty (150) feet in the center of County Highway No. 7 for a Starting point; thence running East Three Hundred (300) feet; thence North Seventy five (75) feet; thence West Three Hundred (300) feet; thence south in the center of County Highway No. 7, Seventy-five (75) feet to the place of beginning. Subject to all easements, current taxes, assessments, restrictions and rights of record. A copy of such proposal is on file in the office of the Zoning Administrator of the City of Nappanee. Written objections that are filed with the office of the Zoning Administrator of the City of Nappanee before the hearing will be considered. All concerned citizens will be offered the right to speak and voice their comment at the Public Hearing. The Public Hearing may be continued from time to time as may be found necessary.
