NOTICE OF PUBLIC HEARING NAPPANEE CITY PLAN COMMISSION The City of Nappanee Plan Commission will hold a Public Hearing Thursday, March 12, 2009 at 7:00 p.m. in the Council Chambers of the City Municipal Building, 300 W. Lincoln St., Nappanee, Indiana. The purpose of this Hearing is to conduct a Public Hearing on Petition #01-09-PLN filed by Brads-Ko Engineering and Surveying Inc. representing Interra Credit Union for a review of a Preliminary plat of Interra Minor Subdivision. Hahn Investments 1203 E. Market St. Nappanee, IN 46550 and Wayside Inc. Nappanee are current owners of the property. Interra Minor Subdivision is located East of North Oakland Avenue and North of East Market street, more particularly described as follows, to-wit: A Part of the northwest quarter (NW 1/4) of Section thirty-two (32), Township thirty-five (35) north, range five (5) East, Union Township, Elkhart County, Indiana more particularly described as follows: Thence 1) North 00 degrees 16 minutes 23 seconds east (assuming the south line of said northwest 1/4 is due east-west) along the west line of said northwest 1/4 and County Road 7 (Oakland Avenue), a distance of 310.00 feet to the Southwest corner of land owned by Thomas E. Barrus II and Angela M. Barrus (Instrument #2003-41071); Thence 2) North 90 degrees 00 minutes 00 seconds east along the south line of said Barrus land and being parallel with the south line of said northwest 1/4, a distance of 300.00 feet to a rebar with cap marked Brads-Ko 0041; Thence 3) South 00 degrees 16 minutes 23 seconds west along the west line of land owned by Randall E. and Beth E. Yoder (Instrument #2008-18724), a distance of 160.00 feet to the north line of land owned by Wayside, Inc. (Instrument #2003-00153); Thence 4) South 90 degrees 00 minutes 00 seconds west along the north line of said Wayside, Inc. land, a distance of 130.0 feet to a rebar with cap marked Brads-Ko 0041; Thence 5) South 00 degrees 16 minutes 23 seconds west along said Wayside, Inc. land, a distance of 150.00 feet to the south line of said northwest 1/4 and being in the pavement of U.S. Highway 6; Thence 6) South 90 degrees 00 minutes 00 seconds west along said south line, a distance of 170.0 feet to the beginning. Containing 1.69 acres, more or less Subject to Public Rights-Of Ways, Easements and Restriction of Record. A copy of such proposal is on file in the office of the Zoning Administrator of the City of Nappanee, Indiana, City Municipal Building, 300 W. Lincoln St., Nappanee, Indiana. Written objections that are filed with the office of the Zoning Administrator of the City of Nappanee before the hearing will be considered. All concerned citizens will be offered the right to speak and voice their comment at the Public Hearing. The Public Hearing may be continued from time to time as may be found necessary.
