NOTICE OF PETITION AND HEARING IN THE KOSCIUSKO SUPERIOR COURT 1 KOSCIUSKO COUNTY, INDIANA IN RE THE GUARDIANSHIP OF NATHANEIL RAY STEPHENS CASE NO. 43D01-0903-GU-5 TO: Any and All Parties Interested in the Guardianship of Nathaneil Ray Stephens On May 22, 2009 at 9:30 a.m. at 121 North Lake Street, Warsaw, Kosciusko County, State of Indiana, the Kosciusko Circuit Court will hold a hearing to determine whether a guardian should be appointed for Nathaneil Ray Stephens. A copy of the petition requesting appointment of a guardian is attached to this notice. At the hearing the Court will determine whether a guardian should be appointed for Nathaneil Ray Stephens. This proceeding may substantially affect the rights of Nathaneil Ray Stephens. If the Court finds that Nathaneil Ray Stephens is an incapacitated person, the Court at the hearing will also consider whether Ruby Stephens should be appointed as guardian of Nathaneil Ray Stephens. The Court may, in its discretion, appoint some other qualified person as guardian. The Court may also, at its discretion, limit the powers and duties of the guardian to allow Nathaneil Ray Stephens to retain control over certain property and activities. The Court may also determine whether a protective order should be entered on behalf of Nathaneil Ray Stephens. Nathaneil Ray Stephens may attend the hearing and be represented by an attorney. The petition may be heard and determined in the absence of Nathaneil Ray Stephens if the Court determines that the presence of Nathaneil Ray Stephens is not required. If Nathaneil Ray Stephens attends the hearing, opposes the petition, and is not represented by an attorney, the Court may appoint an attorney to represent Nathaneil Ray Stephens. The Court may, where required, appoint a guardian ad litem to represent Nathaneil Ray Stephens at the hearing.
