    Notice is hereby given that pursuant to an order of foreclosure and sale of real estate entered by the Untied States District Court for the Northern District of Indiana, South Bend Division, in Cause No. 3:10-cv-00288-JD, wherein Zions First National Bank was Plaintiff, and the Defendants were Higgins & Arnett, LLC, Higgins Sport & Lawn, Inc., Patrick Higgins, The United States Small Business Administration, and Briggs Stratton-Yard Power on the 13th day of December, 2011, the undersigned United States Marshal for the Northern District of Indiana, will conduct a public sale to the highest bidder, on April 17, 2012, at the hour of noon local time, on said day, at the Kosciusko County Justice Building, located at 121 N. Lake Street, Warsaw, Indiana, the following descried real estate located in Kosciusko County, Indiana, Syracuse, Indiana:
    Lots numbered five (5), six (6) and seven (7) in Hunnicutt Addition, Wawasee Lake, Indiana, excepting therefrom the south 20 feet by parallel lines of said lot numbered 7, as recorded in plat book 4, page 50 in the Office of the Recorder of Kosciusko County, Indiana.
together with fixtures, rents, issues, income and profits thereof.
    This public sale will be made without relief from valuation or appraisement laws and the property shall be sold as an entirety. The United States Marshal will accept, and seek court confirmation of, the highest bid offered for this property. The successful bidder must tender payment in the form of a cashier’s or certified check or money order, on such terms as the Marshal directs. The purchaser shall receive a deed thereto after court confirmation of the sale, subject to the express conditions that there are not warranties of title. The interest acquired by the purchaser at said sale shall be subject to any liens for real property taxes or sewer fees assessed against the real estate which may be properly recorded.
    For further particularities regarding this sale, prospective bidders are hereby referred to the order of the United States District Court in the above-captioned case.
