NOTICE OF HEARING ON PROPOSED RATES AND CHARGES Property owners and other interested parties in or served or to be served by the sewage works of the Town of Leesburg, Indiana, are hereby notified that Ordinance No. 2008-4 establishing rates and charges for services to be rendered by the sewage works was introduced at a meeting of the Leesburg Town Council held on May 12,2008. At a meeting of the Leesburg Town Council to be held at 6:30 p.m. (Leesburg time) on June 9, 2008, in the Leesburg Town Hall, there will be a public hearing on the matter of rates and charges, and consideration of adoption of said Ordinance No. 2008-4, which provides in part as follows: Section 3. For the use of the service rendered by sewage works, rates and charges shall be collected from the owners of each and every lot, parcel of real estate or building that is connected with the Town sanitary system or otherwise discharges sanitary sewage, industrial wastes, water or other liquids, either directly or indirectly, into the sanitary sewage system of the Leesburg Municipal Sewage Works. Such rates and charges include user charges, debt service costs, and other service charges, which rates and charges shall be payable as hereinafter provided and shall be in an amount determined as follows: (a) The sewage rates and charges shall be based on the quantity of water used on or in the property or premises subject to such rates and charges as the same is determined by equivalent single-family dwelling units. Sewage service bills shall be rendered once each month (or period equaling a month). In any event, the equivalent dwelling unit ("EDU") for any customer shall not be less than one. The schedule on which said rates and charges shall be determined is as follows: All Class I Users Monthly Rate Billing costs - per monthly bill $3.31 User charge per EDU $32.30 Debt service charge per EDU $37.39 EDU Determinants EDU Factors Residential 176 gpd 1.0 Single family residence 176 gpd 1.0 Apartments/unit 176 gpd 1.0 Mobile home court/space available for rent 176 gpd 1.0 Retail establishments 20 gpd per employee .11 Gasoline service station: with only two (2) restrooms 400 gpd restroom 2.27 with only unisex restroom 600 gpd per restroom 3.41 Restaurants, drive-ins, bars & organizations w/eating and/or drinking facilities 35 gpd per seat .20 Car wash 4400 gpd per car wash bay 2.5 Other commercial 20 gpd per employee .11 Institutional: Schools per pupil enrolled 9 gpd per pupil 0.51 Churches & other religious organizations 5 gpd per seat 0.28 Governmental: Offices 20 gpd per employee .11 Community center 3 gpd per seat 0.17 Industrial 20 gpd per employee .11 The monthly rates and charges provided herein shall be applied throughout the year based upon the maximum sewage service required in any month in any calendar year. For example, the user charges based upon employment shall be applied throughout the year based upon the maximum employment of the user for such single maximum employment month, and such maximum usage shall be applied through the year. (b) In order to produce an amount sufficient to meet the interest on the revenue bonds, and other expenses, payable prior to the completion of the work, after the contract for construction of sewer system has let and the actual work commenced thereunder, the owners of each and every lot, parcel of real estate or building to be connected with the Town's sanitary sewage system, as a result of construction of said works, shall pay, each month 50 percent of the rates and charges established above, for each such building to be connected. Beginning with the first month after the sanitary sewers are available for connection and use to any lot, parcel of real estate or building, the full rates and charges shall become effective for such lot, parcel or real estate or building; but in any event, said full rates and charges shall become effective no later than January 1,2009. Section 4. (c) As is provided by statute, all rates and charges not paid by the 15th day of the month following receipt of billing are hereby declared to be delinquent and a penalty of ten percent (10%) of the amount of the rates and charges shall thereupon attach thereto. Section 7. The owner of any lot, parcel of real estate, or building connecting to the sewage works shall, prior to being permitted to make a connection, pay an inspection fee in the amount of Twenty-five Dollars ($25.00) for each connection. At such hearing and prior to final adoption of said Ordinance, all interested parties may appear and be heard. A copy of Ordinance No. 2008-4 may be examined at the Town Hall.
