NOTICE OF HEARING ON PETITION FOR VACATION OF PUBLIC WAY To: Residents of the City of Warsaw, Kosciusko County, Indiana You are hereby notified that on the 18th day of May, 2009 at 7:00 p.m. in the Council Chambers, City Hall, Warsaw, Indiana, the Common Council of the City of Warsaw, Indiana will conduct a hearing in regard to a petition filed by Menard Inc., Dale E. Hermann and M Joan Hermann for vacation of a portion of a public way (Husky Trail) located within the limits of the City of Warsaw, Kosciusko County, Indiana, and described as follows: A part of the Southwest Quarter of Section 3; a part of the Southeast Quarter of Section 4; a part of the Northeast Quarter of Section 9; and a part of the Northwest Quarter of Section 10, all in Township 32 North, Range 6 East, in the City of Warsaw, Kosciusko County, Indiana, and being described as follows: Commencing at a bronze marker found at the Southeast comer of the Southeast Quarter of said Section 4; thence South 89 degrees 46 minutes 42 seconds West along the south line of said quarter section a distance of 47.47 feet to the Southwest right-of-way of County Road 100 East (Husky Trail), and the Point of Beginning; thence along said right-of-way the following three courses: (1) Northeasterly along a tangent curve to the right (said curve having a radius of 368.31 feet, a chord bearing of North 02 degrees 46 minutes 00 seconds West, a chord distance of 43.23 feet) an arc distance of 43.26 feet; (2) North 00 degrees 35 minutes 54 seconds East a distance of 106.83 feet; (3) North 16 degrees 14 minutes 26 seconds East a distance of 106.06 feet; thence Southeasterly along a non-tangent curve to the left, said curve being a Northwesterly extension of the Husky Trail right-of-way as depicted on the plat of Menards Subdivision as recorded in Plat Book 13, page 60 of Instrument No. 20077323 in the Office of the Recorder of Kosciusko County, Indiana, (said curve having a radius of 560.00 feet, a chord bearing of South 25 degrees 31 minutes 18 seconds West, a chord distance of 156.22 feet) an arc distance of 156.73 feet passing into the Southwest Quarter of Section 3, to a comer of Lot 13 of said plat; thence along said plat the following three courses: (1) South 09 degrees 48 minutes 44 seconds East a distance of 69.82 feet; (2) Southeasterly along a non-tangent curve to the left passing into the Northwest Quarter of Section 10 (said curve having a radius of 258.27 feet, a chord bearing of South 16 degrees 27 minutes 42 seconds East, a chord distance of 151.55 feet) on arc distance of 153.82 feet; (3) South 33 degrees 31 minutes 07 seconds East a distance of 595.76 feet to a south comer of Lot 4; thence South 55 degrees 58 minutes 28 seconds West along the northeast right-of-way line of Parker Street per Indiana Deportment of Transportation Project ST-F-854(l8), a distance of 120.01 feet to the southwest right-of-way of County Road 100 East (Husky Trail) as defined in Indiana Department of Transportation Project ST-F-854(18); thence along said right-of-way the following three courses: (1) North 33 degrees 31 minutes 06 seconds West a distance of 573.22 feet; (2) North 23 degrees 18 minutes 10 seconds West, passing into the Northeast Quarter of Section 9, a distance of 101.96 feet; (3) Northerly along a tangent curve to the right (said curve having a radius of 368.31 feet, a chord bearing of North 13 degrees 48 minutes 43 seconds West, a chord distance of 98.45 feet) an arc distance of 98,75 feet to the Point of Beginning, containing 0.19 acre in Section 3; 0.24 acre in Section 4; 0.09 acre in Section 9 and 1.92 acres in Section 10; containing, in all, 2.44 acres more or less.
