NOTICE OF COMPLAINT STATE OF INDIANA SS COUNTY OF KOSCIUSKO J&D ENTERPRISES, LLC, Plaintiff v. INDIANA-AMERICAN WATER COMPANY, INC. AND ANY PERSONS CLAIMING AN INTEREST IN THE REAL ESTATE DESCRIBED HEREIN, Defendants IN THE KOSCIUSKO SUPERIOR COURT NO. 1 CAUSE NO. 43D01-1609-PL-98 To: Any persons claiming an interest in the Real Estate described herein. You are hereby notified that J & D Enterprises LLC has filed its Complaint in the above Court seeking judgment determining Plaintiff to be the owner of the following described real estate located in Kosciusko County, Indiana: A tract of land in the north half of the northwest quarter of section 15, township 32 north, range 6 east, Wayne Township, City of Warsaw, Kosciusko County, Indiana, more particularly described as follows: Commencing at a Walker cap pin at the intersection of the east right-of-way line of Argonne Road and the north right-of-way line of the Conrail Railroad (previously recorded the Penn-Central Railroad); thence south 70º20'11" east (basis of bearings established by INDOT VRS Base, using Indiana East NAD83 coordinate system), along said north right-of-way, 671.38 feet (recorded 657.92 feet more or less) to the east right-of-way line of Adams Street; thence north 00º04'23" east, along said east right-of-way of Adams Street, 410.00 feet to a McCrea cap pin at the northwest corner of Lot #1 in the Plat of East Tower, also being the northwest corner of property owned by Water Utilities Incorporated recorded in Deed record 191, page 456 and the Point of Beginning; thence continuing north 00º04'23" east, along said east right-of-way, 12.68 feet to the southwest corner of property owned by J&D Enterprises TLC. recorded in Doc. #1996050751 being 1.3 feet east of a 3/4" pipe; thence north 88º50'10" east, along the south line of said J&D property and the south line of J&D property recorded in Doc. #1996050752, 500.29 feet to the southeast corner of said J&D property being 0.4 feet West of a 3/4" pipe; thence south 02º36'11" west, 24.50 feet to a McCrea cap in at the northeast corner of lot #2 in said East tower Plat ad the northeast corner of said Water Utilities Deed; thence north 89º48'47" west, along the north line of said lots and the north line of said Water Utilities Deed, 499.10 feet to the point of beginning containing 0.21 acres more or less. If you claim an interest in the afore-described real estate, you or your attorney must respond to the Complaint filed by Plaintiff within 30 days of the last date of publication of this notice.
