Jordan K. Costello is notified that a Petition for Adoption of a Child, named Karmella Nikkole Costello (hereafter “minor child”), born December 19, 2013, was filed in the Office of the Clerk of Allen Superior Court, 715 S. Calhoun Street, Room 200, Fort Wayne, Indiana, 46802. The Petition for Adoption alleges that Jordan K. Costello’s consent to the adoption of minor child is not required pursuant to Indiana Code 31-19-9-8(a)(2)(A) and (B), which states that a birth parent’s consent to an adoption is not required by a parent of a child in the custody of another person if for a period of at least one (1) year the parent (a) knowingly fails to provide for the care and support of the child when able to do so as required by law or judicial decree or fails, without justifiable cause, to communicate significantly with a minor child when able to do so. Additionally, pursuant to Indiana Code 31-19-9-8(b), if a parent has made only token efforts to support or communicate with the child, the Court may declare the child abandoned by the parent, thereby making his consent unnecessary. The Petition for Adoption alleges that Jordan K. Costello’s consent is not required pursuant to each of the aforementioned statutes.
If Jordan K. Costello does not file a Motion to Contest the Adoption within thirty (30) days after service of this Notice, the above named Court will hear and determine the Petition for Adoption. Jordan K. Costello’s consent to the adoption of minor child will be irrevocably implied and Jordan K. Costello will lose the right to contest either the adoption or the validity of Jordan K. Costello’s implied consent to the adoption.
No oral statement made to Jordan K. Costello relieves Jordan K. Costello of his obligations under this notice.
