NOTICE OF ADOPTION
TO UNNAMED FATHER
STATE OF INDIANA
SS:
COUNTY OF KOSCIUSKO
IN THE KOSCIUSKO SUPERIOR COURT NO. 1
CAUSE NO.: 43D01-2404-AD-16
CAUSE NO.: 43D01-2404-AD-17
CAUSE NO.: 43D01-2404-AD-18
IN THE MATTER OF THE ADOPTION OF
Z. A. R. T.,
Z. R. T., Z. T., A Minor Child
To: Unknown Father
Unknown Address
The unnamed putative father of a male child named, Z.A.R.T, born on May 4, 2008, in Chicago, Cook County, Illinois, to Kamisha L. Terry, a male child named, Z.R.T, born on March 18, 2011, in Chicago, Cook County, Illinois, to Kamisha L. Terry, or a male child named, Z.T, born on December 2, 2009, in Chicago, Cook County, Illinois, to Kamisha L. Terry, or a person who claims to be the father of any of such children, is hereby notified that a petition for adoption for each has been filed in the Office of the Clerk of the Kosciusko Circuit/Superior Courts, located at 121 N. Lake Street, Warsaw, Indiana 46580, 574-372-2334. The petitions for adoption allege that consent to adoption by the unnamed putative father is not required because he has abandoned said child for at least six (6) months; or he has, for a period of at least one (1) year, failed without justifiable cause to communicate significantly with the child when able to do so or knowingly fails to provide for the care and support of the child when able to do so as required by law or judicial decree; or he has failed to establish paternity; or he has failed to timely register with the Putative Father Registry pursuant to I.C. 31-19-5 in the State of Indiana or in the State where such child was conceived.
If the unnamed putative father seeks to contest the adoption of any of such children, the unnamed putative father must file a motion to contest the adoption in accordance with I.C. 31-19-10-1 in the above-named court not later than fifteen (15) days after the date of service of this notice. This notice may be served by publication.
If the unnamed putative father does not file a motion to contest the adoption within fifteen (15) days after service of this notice, the above-named court will hear and determine the petition for adoption. The consent to adoption of the unnamed putative father will be irrevocably implied and the unnamed putative father will lose the right to contest either the adoption or the validity of the unnamed putative father’s implied consent to the adoption. The unnamed putative father loses the right to establish paternity of the child, by affidavit or otherwise, in Indiana or any other jurisdiction.
Nothing that Kamisha L. Terry or anyone else says to the unnamed putative father of the child relieves the unnamed putative father of his obligations under this notice.
Under Indiana law, a putative father is a person who is named as or claims that he may be the father of a child born out of wedlock but who has not yet been legally proven to be the child’s father.
This notice complies with I.C. 31-19-4-4 but does not exhaustively set forth the unnamed putative father’s legal obligations under the Indiana adoption statutes. A person being served with this notice should consult the Indiana adoption statutes.
