NOTICE OF HEARING ON PROPOSED ORDINANCE AMENDING ORDINANCES

NO. 75-10, 93-8, 95-9, 2003-l0, 2003-15 AND 2004-06 FIXING THE SCHEDULE OF RATES AND CHARGES

TO BE COLLECTED BY THE TOWN OF NORTH WEBSTER, INDIANA, FROM THE OWNERS OF PROPERTY

SERVED BY THE SEWAGE WORKS OF SAID TOWN AND OTHER MATTERS CONNECTED THEREWITH

You are hereby notified that a public hearing will be held before the Common Council of the Town of North Webster on December 14. 2010 at the hour of 6:00 p.m. (Local Time) at the North Webster Community Center located at 301 North Main Street, North Webster, Indiana, upon a proposed ordinance amending the schedule of rates and charges to be collected by the Town of North Webster, Indiana, from the owners of property served by the sewage works of said town and other matters connected therewith.

The proposed Ordinance reads as follows: That Sections One of Ordinances No. 93-8 and 95-9, which is Section 3 of Ordinance No 75-10, Ordinance No, 2003·10, Ordinance No. 2003-15, and Ordinance No. 2004-06 are hereby amended to read as follows:

Section 3. For the use of and the service rendered by said sewage works, rates and charges shall be collected from the owners of each and every lot, parcel of real estate, or building that is connected with the Town sanitary system or otherwise discharges sanitary sewage, industrial wastes, water, or other liquids, either directly or indirectly, into the sanitary sewage system of the Town of North Webster. Such rates and charges include user charges, debt service costs, excessive strength surcharges, and other service charges which rates and charges shall be payable as hereinafter provided and shall be in an amount determinable as follows,

(a) Sewage Rates and Charges: Unmetered User Charges The sewage rates and charges for users not metered shall be based on the estimated quantity

of water used on or in the property or premises subject to such rates and charges, as the same is determined by equivalent single family dwellings. Sewage service bills shall be rendered once each month (or period equaling a month). The amount of said rates and charges shall be the total of $1.98 per month for each user subject to sewer charges, plus a charge for user charges and debt service, which shall be determined as follows:

(b)
For the service rendered to the Town of North Webster, said Town shall be subject to the same rates and charges herein above provided, or to charges and rates established in harmony therewith.
(c)
The monthly rates and charges provided herein shall be applied throughout the year based upon the maximum sewage services required in any month in any twelve (12) month period. For example, user charges based upon employment shall be applied throughout the year based upon the maximum employment of the user for such single maximum employment month, and [he monthly charge to a wholesale metered user shall be based upon the highest volume of flow received by the Town in the eleven months preceding the billing of the current month’s service.

(d) Institutions that have restaurant facilities shall determine their equivalency factor in

accordance with Section 3(a) above for Institutional and Commercial-Restaurant connections. SECTION TWO

(a)
Normal sewage domestic waste strength should not exceed a biochernical oxygen demand of 240 milligrams per liter of fluid, suspended solids in excess of [240 milligrams per liter of fluid, or phosphorus in excess of 12 milligram per liter of fluid. Additional charges for treating stronger-thannormal domestic waste shall be made on the following basis:
(1)
Rate Surcharge Based Upon Suspended Solids- There shall be an additional charge of 3.89¢ per pound for suspended solids received in excess of 240 milligrams per liter of fluid.
(2)
Rate Surcharges Based Upon BOD - There shall be an additional charge of 26.3¢ per pound of biochemical oxygen demand for BOD received in excess of 240 milligrams per liter of fluid.
(3)
Rate Surcharge Based Upon Phosphorus -There shall be an additional charge of $2.85 per pound of phosphorus received in excess of 12 milligrams per liter of fluid. SECTION THREE

Differences arising between users and officials of the sewage works that cannot be resolved between the users and the official or officials involved may be appealed to the Town Council of the Town of North Webster. The decision by the Town Council shall be binding upon all concerned.

SECTION FOUR The Sewage Rates and Charges herein set forth shall become effective on January 1, 2011, and his Ordinance shall be in full force and effect after is passage and signing by the Town Council. Dated this 16th day of November, 2010. Alice Luce, Clerk/Treasurer n24
