REQUEST FOR PROPOSAL IN REGARD TO NORTH WEBSTER REAL ESTATE Pursuant to I.C. 36-1-11-1, the Town Council of North Webster, Indiana requests proposals for use of certain Town of North Webster property commonly known as Wastewater Acreage, North Webster. Interested parties should submit their detailed proposal for farming of the property for consideration by the North Webster Town Council. The proposals shall include a description of the intended agricultural or farm use for the property, the rent or other compensation proposed to be paid, the proposed terms of lease, any proposed improvements to the real estate, along with a statement evidencing the interested party's financial responsibility. All proposals will be evaluated based upon factors and criteria including the following: 1. The proposed tenant's ability to perform the following mandatory activities: 1.1 Provide all labor necessary to spread leaves and dry sludge from the Landlord's sewage treatment plant (collectively "Sludge") as well as incorporation of said sludge to the ground utilizing equipment supplied by the Landlord and Tenant. 1.2 Incorporation to be carried out in accordance with the requirements of the Indiana Department of Environmental Management ("IDEM") as stated in 327 IAC 6.1 and discussed by Landlord's Representative and Tenant. 1.3 Tenant to provide two tractors of adequate size to perform stated duties, spreader large enough to reasonably spread sludge in a timely manner, loader for loading spreader with stockpiled sludge and incorporation equipment as discussed by Landlord's representative and Tenant (disc, plow, etc.). 1.4 Be available to spread the sludge on the Premises (either the Town's field or other field to be determined later) at such appropriate times before planting and after harvest, to be determined by both parties. 1.5 Spread the sludge only in conformance with and under the direction and supervision of Landlord's designated agents operating its sewage treatment plant to ensure compliance with 327 IAC 6.1. 2. Return on investment to the town; 3. Financial stability of the applicant; 4. Unique services provided by the proposal; 5. Applicant's prior experience with the proposed use; Applicants should be aware that any proposal must confirm that the applicant is capable of performing all tasks identified above and be further aware that price or rent will not be the sole determining factor in evaluating proposals. Although rent or return on investment is important, the other identified criteria will also be very significant and probably more important factors in evaluating all proposals. The property may not be leased to a person who is ineligible under I.C. 36-1-11-16 and, any proposal submitted by a trust (as defined by I.C. 30-4-1-1(a)) must identify each beneficiary of the trust and each settlor empowered to revoke or modify the trust. The council reserves the right to request additional information from any applicant to establish financial responsibility. The council also reserves the right to conduct discussions with offerors for the purpose of clarification to assure a full understanding of and responsiveness to the solicitation requirements.
