ORDINANCE NO. 2013-02 AN ORDINANCE PROHIBITING THE USE, SALE, DELIVERY, MANUFACTURING MARKETING OR POSSESION OF SYNTHETIC DRUGS AND SYNTHTIC DRUG LOOKALIKE SUBSTANCES IN THE TOWN OF NORTH WEBSTER, INDIANA WHEREAS, the Marshall of the Town of North Webster has recommended to the Town of North Webster that it would be prudent, and in the best interest of the citizens of the Town of North Webster, and the public in general, to prohibit the use, sale, delivery, manufacturing, marketing or possession of synthetic drugs and synthetic drug lookalike substances in the Town of North Webster, Indiana; and, WHEREAS, the Town Council has determined that it would be in the best interest of the citizens of the Town of North Webster and the public in general to adopt an ordinance as recommended by the Marshall. NOW, THEREFORE, BE IT ORDAINED by the Town Council of the Town of North Webster, Indiana, as follows: Section 1. It shall be unlawful to use, sell, deliver, manufacture, market, or possess a synthetic drug as defined by Indiana Code 35-31.5-2-321 or a synthetic drug lookalike substance as defined in Indiana Code 35-31.5-2-321.5 in the corporate limits of the Town of North Webster. Section 2. The Town Marshall and all Police Officers constituted and acting under the authority of the Town of North Webster are authorized and ordered to confiscate any synthetic drugs and any drug lookalike substances found within the corporate limits of the Town of North Webster. Section 3. Any person or entity of any kind found to be in violation of this ordinance shall be subject to a fine of $250.00 for each day such person or entity shall be found to be in violation of this ordinance, and upon a second or subsequent offense shall be fined in the amount of $500.00 for each day such person or entity is found to be in violation of this ordinance. THEREFORE, this Ordinance shall be in full force and effect from after its passage and due attestation and publication as required by law.
