AN ORDINANCE AMENDING SECTION 70.15 OF THE TOWN CODE OF THE TOWN OF NORTH WEBSTER, INDIANA REGARDING EMERGENCY ACCESS AREAS
WHEREAS, the Town Council of the Town of North Webster, Indiana, recognizes that the current regulation and permit procedure is inadequate to properly regulate use of the Emergency Access Areas.
WHEREAS, the Town Council of the Town of North Webster desires to establish a permit fee for use of the Emergency Access Area as a part of the permit procedure and to establish a fine as a penalty for violation of Section 70.15 of the Town Code of the Town of North Webster, Indiana.
NOW, THEREFORE, BE IT ORDAINED BY THE TOWN COUNCIL OF THE TOWN OF NORTH WEBSTER, INDIANA:
SECTION 1
The North Webster Town Code, Section 70.15 is amended as follows: (C) is amended by adding the following at the end of the paragraph:
"Permits hereunder are intended for issuance only to commercial interests associated with the use of the lake, such as businesses engaged in the installation or removal of piers/boat lifts or access for non-profit organizations for lake association events. The Clerk/Treasurer shall collect a fee in the sum of Four Hundred Twenty dollars ($420.00), on an annual basis, prior to issuance of each permit. The permit fee may be waived for a permit issued to an appropriate non-profit organization for a lake associated event."
Section 70.15 of the Town Code of the Town of North Webster, Indiana is further be amended by adding an additional section as follows:
(E) The penalty for violation of this ordinance shall be a fine in the amount of Five Hundred dollars ($500.00) for a first offense, One Thousand dollars ($1,000.00) for a second offense and One Thousand Five Hundred dollars ($1,500.00) for any subsequent offense.
SECTION 2
The Town declares an emergency and this Ordinance shall be in full force and effect from and after its passage and due attestation and publication as required by law.
