ORDINANCE NO. 2013-01 AN ORDINANCE AMENDING CHAPTER 90 OF THE TOWN CODE OF NORTH WEBSTER, STATE OF INDIANA IN REGARD TO ANIMAL WASTE WHEREAS, the Town Council of the Town of North Webster has determined that Chapter 90 of the Town Code of the Town of North Webster requires modification to provide for the proper disposal of animal solid waste in the Town of North Webster; and, WHEREAS improper disposal of animal solid waste in the Town of North Webster has and will present public health, safety and welfare issues. NOW, THEREFORE, BE IT ORDAINED BY THE TOWN COUNCIL OF THE TOWN OF NORTH WEBSTER, INDIANA, THAT: Section 1: Chapter 90 of the Town Code of North Webster is hereby amended by adding the following terms of § 90.01 Definitions: Immediate. Immediate shall mean that the animal solid waste is removed at once, without delay. Animal Solid Waste. Animal solid waste shall mean waste matter expelled from the bowls of an Animal; excrement. Proper Disposal. Proper disposal shall mean placement in a designated waste receptacle, or other suitable container, and discarded in a refuse container which is regularly emptied by the municipality or some other refuse collector. Section 2: Chapter 90 of the Town Code of North Webster shall be further amended by adding the following: § 90.12 Pet Solid Waste Disposal. All Animal Owners and any other person who shall possess, maintain, house or harbor any Animal or otherwise have custody of any Animal whether or not the owner o such Animal, shall immediately and properly dispose of the Animal's solid waste deposited on any property, public or private, not owned or possessed by that person. Section 3: Enforcement. This ordinance shall be enforced according to the penalty provisions of § 90.99 of the Town Code of the Town of North Webster. Therefore, this Ordinance shall be in full force and effect from after its passage and due attestation and publication as required by law.
