NOTICE OF THE FINDINGS OF FACT AND FINAL ORDER OF THE JOINT NOBLE-KOSCIUSKO COUNTY DRAINAGE BOARD FOR THE CROMWELL WATERSHED PERIODIC MAINTENANCE HEARING RE: PART OF SECTIONS 5, 6, 7, 8, 9,16, 17 & 21 OF SPARTA TOWNSHIP, NOBLE COUNTY, INDlANA, and PART OF SECTIONS 1, 2, 3, 10, 11 & 12 OF TURKEY CREEK TOWNSHIP, KOSCIUSKO COUNTY, INDlANA, and THOSE AREAS SERVED BY THE TURKEY CREEK. REGIONAL SEWER DISTRICT IN BOTH NOBLE AND KOSCIUSKO COUNTIES. The Joint Noble-Kosciusko County Drainage Board now renders its Final Order for the periodic maintenance of the Cromwell Watershed System. After due consideration of all the reports, evidence, testimony and other information presented through the course of a public proceeding held at 3:00 p.m. on January 10, 2011 in Meeting Rooms A & B of the Noble County Public Library, Albion, Indiana, the board now enters its Final Order. NOW THEREFORE, IT IS ORDERED by the Joint Noble-Kosciusko County Drainage Board that: A. The Findings of Fact are adopted by the Board as true and accurate for this proceeding; AND B. The Report of the Surveyor and the schedule of assessments along with any amendments to the report or schedule shall be adopted and the periodic maintenance rates shall be established as follows: $ 4.00/Acre; with a $ 50.00 Minimum Rate per Tract of Land; and $10.00 Per each Residential Equivalent Unit (REU) in the Turkey Creek Regional Sewer District that discharges into this watershed. Copies of the same shall be attached hereto and made a part hereof by this reference; AND C. Public announcement of said order is hereby made on this periodic maintenance hearing; AND D. If judicial review of the Findings or Order of the Board is not requested pursuant to I.C. 36-9-27-106 through 108 within 20 (twenty) days from the date of publication of the aforementioned notice, the Findings and Order shall become conclusive and the Surveyor shall proceed according to law. The Findings of Facts and the Final Order of the Noble County Drainage Board in the matter of the Cromwell Watershed Periodic Maintenance Hearing are on file and available for inspection in the Office of the Noble County Surveyor located at 2090 North - State Road 9, Suite B, Albion, Indiana 46701.
