Editor’s Note: The following letter was sent Sept. 18 in response to an inquiry from the Indiana Election Division. District 22 State Representative Candidate Curt Nisly, R-Goshen, asked that it be published as a letter to the editor.
Editor, Times-Union:
Dear Mr. Deckard and Mr. King:
Thank you for your letter dated Sept. 4, 2014, regarding the complaint filed by David Kolbe, candidate for Indiana State Representative District 22. Please accept this as my response to the complaint. I deny the allegations raised by Mr. Kolbe, there is no merit to his complaint.
Though Mr. Kolbe does not cite any code violations in his complaint, I wish to clarify the following items:
During September 2013, C-Tech Solutions Inc. had discussions with the Elkhart County Clerk’s office about website design. On Oct. 3, 2013, C-Tech Solutions Inc., had a mock-up of the proposed website ready for the Elkhart County Clerk. Work on the website continued, and the first week of December 2013, C-Tech Solutions Inc., invoiced the Elkhart County Clerk for the website design. I filed my declaration of candidacy for Indiana State Representative District 22 on Jan. 21, 2014.
There was a functioning link from the website designed for the Elkhart County Clerk to C-Tech Solutions Inc. This was a standard advertising link. Elkhart County Clerk Wendy Hudson informed me by telephone sometime after 10 p.m. on Aug. 13, 2014, that the link had to be broken at once. I informed my staff of the need to sever the website link, and at 5:30 a.m. on Aug. 14, 2014, my staff notified me the link was disabled.
At no time was there a direct link from the Elkhart County Clerk website to the campaign website, CurtNisly.com, to the campaign Facebook page, nor to the platform for campaign donations and signing up volunteers.
There is no relationship between C-Tech Solutions Inc. and the technology to operate the Vote Centers in Elkhart County. There is no impropriety and no conflict of interest.
The website for the Elkhart County Clerk does not contain any data about voters, voter registration or other voter information. The website for the Elkhart County Clerk is hosted on a separate server and is isolated from all voter information.
Conversion of IP addresses to physical addresses would require assistance from the IP provider(s). Neither the Curt Nisly campaign, nor C-Tech Solutions Inc., nor I personally, engaged in conversion of IP addresses to physical addresses.
I received my information on registered voters in Elkhart County from Chad Clingerman, the manager of Voter Registration, using methods that are readily available to any candidate.
The campaign website, CurtNisly.com, was designed by C-Tech Solutions Inc. and subcontracted to Higher Standard Enterprises LLC., which in turn invoiced the campaign directly.
Higher Standard Enterprises LLC is a legal entity in the state of Indiana. Should you require any additional information regarding this complaint, please contact me.
