NOTICE OF PUBLIC HEARING NAPPANEE BOARD OF ZONING APPEALS The City of Nappanee Board of Zoning Appeals will hold a Public Hearing, Tuesday, September 9, 2008 at 6:00 pm in the Council Chambers of the City Municipal Building, 300 West Lincoln Street, Nappanee, Indiana. The purpose of this Hearing is to hear a variance request, #07-08-BZA, filed by Martin's Super Markets, 760 West Cotter St., South Bend, Indiana 46613 for the property located at 242 N. Oakland Avenue, Nappanee, IN 46550. The petitioners are requesting approval of a variance to increase the total square footage of their sign to 200 square feet. The legal description of the property is described as follows: A part of the northeast quarter (NE 1/4) of section 31, township 35 north 5 east, situated in Union Township, City of Nappanee, Elkhart County, Indiana, State of Indiana, more particularly described as follows: Commencing at the southeast corner of the northeast quarter of said section 31; thence north along the east line of the northeast quarter (NE 1/4) of said section 31 a distance of 321.75 feet to the southeast corner of land conveyed to Kenneth and Miriam Stump in DR 400, PG 689, along being the southeast corner of land conveyed to MLS Operating Company in DR 95-010004; thence west along the south line of said MLS land and along the south line of said conveyed to City of Nappanee in DR98-009025 a distance of 35 feet to the Southeast corner of land conveyed to Martin's Super Markets, Inc. in DR 2006-24697, said point being the place of beginning of this description; thence continuing west along the south line of said Markets land a distance of 430 feet to the southwest corner of said Markets land, said corner being the southeast corner of land conveyed to Lake County Trust Company in DR-89-006984; thence north along the east line of said trust land and the west line of said Markets land a distance of 400.25 feet to the northeast corner of said trust land; thence north 75 degrees 27 minutes 57 seconds west along the north line of said trust land a distance of 241.29 feet to a point; thence north 78 degrees 34 minutes 08 seconds west along the north line of said trust land and the north line of land conveyed to Martin's Realty of Nappanee LLC in DR 97-007118 a distance of 236.70 feet to a point; thence north 84 degrees 59 minutes 50 seconds west along the north line of said realty land a distance of 146.44 feet to a point; thence south 89 degrees 45 minutes east a distance of 923.96 feet to a point; thence south 10 feet to a point on the north line of said Markets land; said point being 117.5 feet west of the northeast corner of said Markets land; thence east along the north line of said Markets land a distance of 117.5 feet to the northeast corner of said Markets land and a point on the west line of said city land; thence south along the east line of said Markets land and along the west line of said city lane a distance of 506.51 feet to the place of beginning of this description. Containing 5.76 acres of land. A copy of such proposal is on file in the office of the Zoning Administrator of the City of Nappanee, City Municipal Building, 300 W. Lincoln St., Nappanee, Indiana. Written objections that are filed with the office of the Zoning Administrator of the City of Nappanee before the hearing will be considered. All concerned citizens will be offered the right to speak and voice their comment at the Public Hearing may be continued from time to time as may be found necessary.
