NOTICE OF PUBLIC HEARING Notice is hereby given to the citizens of the City of Nappanee, Elkhart and Kosciusko County, State of Indiana, that the Board of Public Works and Safety of the City of Nappanee at its regular meeting on Monday, November 23, 2009 at 3:30 PM, in the Council Chambers at the Nappanee Municipal Center, will consider a petition from the LT Properties, LLC - Thomas Mast, to vacate the alley right-of-way, located East of Good's 1st Addition Lot 1 and adjoining 401 East Market Street as well as the alley South of Good's 1st Addition Lots 1 & 2, adjoining Good's 1st Addition Lot 10 within the corporate limits of the City of Nappanee, Indiana. The alley right-of-way in question is described as follows: 12' Alley Vacation - A portion of a 12 foot wide alley in Isaiah R. Good's 1st Addition to Nappanee as recorded in Deed record 59, page 2 1/2 in the office of the Recorder of Elkhart County, Indiana, more particularly described as follows: Beginning at the Northwest corner of Lot #1 in said Isaiah R. Good's 1st Addition to Nappanee; thence West, along the South right-of-way of Market Street (US Route #6), 12.0 feet to the Northeast corner of Lot #1 in C, Z & M Subdivision as recorded in the office of the Recorder of Elkhart County, Indiana; thence South along the East line of said Lot #1 in C, Z & M Subdivision, 148.5 feet to the intersection with the Westerly extension of the North line of Lot #10 in said Isaiah R. Good's 1st Addition to Nappanee; thence East, along said extension, 12.0 feet to the Northwest corner of said Lot #10; thence North along the Southerly extension of the West line of said Lot #1 in Isaiah R. Good's 1st Addition to Nappanee and along said West line, 148.5 feet to the Point of Beginning, containing 0.041 acres more or less. Subject to all covenants, easements, or restrictions of record and all applicable building and zoning laws and ordinances and possible rights of time and drainage ditches. 16.5' Alley Vacation - A portion of a 16.5 foot wide alley in Isaiah R. Good's 1st Addition to Nappanee as recorded in Deed record 59, page 2 1/2 in the office of the Recorder of Elkhart County, Indiana, more particularly described as follows: Beginning at the Northwest corner of Lot #10 in said Isaiah R. Good's 1st Addition to Nappanee; thence North, 16.5 feet to the Southwest corner of Lot #1 in said Isaiah R. Good's 1st Addition to Nappanee; thence East, along the South line of said Lot #1, 66.0 feet to the Southeast corner of said Lot #1; thence South, 16.5 feet to a point on the North line of said Lot #10; thence West, along said North line, 66.0 feet to the Point of Beginning, containing 0.025 acres more or less. Subject to all covenants, easements, or restrictions of record and all applicable building and zoning laws and ordinances and possible rights of time and drainage ditches. Said Petition will be considered at this meeting and citizens of the City will be given the opportunity to speak during the public hearing.
