NOTICE OF PUBLIC HEARING
NAPPANEE BOARD OF ZONING APPEALS
    The City of Nappanee Board of Zoning Appeals will hold a public hearing Tuesday, May 8, 2012 at 6:00 p.m. in the Council Chambers of the City Municipal Building, 300 W. Lincoln St., Nappanee, Indiana.
    The purpose of the Hearing is to hear variance request #02-12-BZA, filed by LT Properties, Thomas Mast, owner, 401 E. Market Street Nappanee, Indiana 46550.
     The request is for a variance from the required 50-foot front yard set back on a primary arterial to allow the construction of a light temporary structure to cover a grill/cooker/smoker that is to be used by a tenant, Culinary Mill Market and Deli. The construction of the temporary structure will have a 0 foot setback on Market Street.  The subject property is located at 401 E. Market Street, Nappanee, IN 46550.
    LEGAL DESCRIPTION OF THE PROPERTY: A part of the Southwest Quarter of Section 31, Township 35 North, Ranger 5 East,  City of Nappanee, Elkhart County, Indiana, described as follows:    
    Beginning at an iron Stake on the South line of Market Street (the South line of said Street being parallel with and 41.25 feet South of the North line of said Quarter Section) at the intersection of the South line of said Street with the East line of the alley on the East side of Best and Early’s Addition to the City of Nappanee; thence South 89 degrees  45 minutes East along the South line of said Market Street 400.76 feet to an iron stake on the West line of a 12 foot alley on the West side of I.R. Good’s First Addition to the City of Nappanee; thence due South on the West line of said alley, and it’s extension thereof, 284.64 feet, to the North right of way line of Lincoln Street; thence North 89 degrees 31 minutes West on the extension of the North right of way line of said Lincoln Street, 402.20 feet to the East line of the alley on the East side of Best and Early’s Addition to the City of Nappanee; thence North 00 degrees 23 minutes East on the East line of said alley, 283.47 feet to the point of beginning.
    A copy of such proposal is on file in the office of the Zoning Administrator of the City of Nappanee, Indiana, City Municipal Building, 300 W. Lincoln St., Nappanee, Indiana.
    Written objections that are filed with the office of the Zoning Administrator of the City of Nappanee before the hearing will be considered.
    All concerned citizens will be offered the right to speak and voice their comment at the Public Hearing. The Public Hearing may be continued from time to time as may be found necessary.
