NOTICE OF PUBLIC HEARING
    Notice is hereby given to the Citizens of the Civil City of Nappanee, Elkhart County and Kosciusko County, State of Indiana, that the Common Council of the Civil City of Nappanee, at it’s regular session scheduled at 7:00 PM on Monday, June 6th, 2016 in the Council Chambers at the Nappanee Municipal Center, 300 West Lincoln Street, Nappanee, Indiana, will hold a Public Hearing on Ordinance No. 1519 to annex contiguous real estate into the corporate boundaries of the City of Nappanee, Indiana.
    The Public Hearing will be for Ordinance No. 1519, an Ordinance annexing certain contiguous territory to the City of Nappanee, Indiana and declaring the same to be a part of the City of Nappanee, Indiana, and prescribing the zoning and land use therefore, this petition being filed by Heritage Farms LLC.  The real estate is more particularly described as follows:

REAL ESTATE
Legal Description –

    A part of the Southwest quarter of section 29, township 35 North, Range 5 East, Union Township, Elkhart County, State of Indiana, and being more particularly described as follows: Commencing at a Harrison monument marking the Northwest corner of the Southwest quarter of said section 29; thence on an assumed bearing of South 90 degrees 00 minutes 00 seconds East along the North line of the Southwest quarter of said section 29 and the centerline of County Road number 52, a distance of 1645.20 feet to a railroad spike marking the Northeast corner of a parcel of land conveyed to Jonas E. and Mary A. Hochstetler as described and recorded in the office of the recorder of Elkhart County in instrument number 96 017658; thence south 00 degrees 06 minutes 46 seconds West along the East line of said Hochstetler parcel, a distance of 618.81 feet to the point of beginning of this description; thence South 90 degrees 00 minutes 00 seconds East parallel with the North line of the Southwest quarter of said section 29, a distance of 350.53 feet to the West line of a parcel of land conveyed to Patrick N. Mishler as described and recorded in the office of the recorder of Elkhart County in instrument number 2003-26632; thence South 00 degrees 05 minutes 00 seconds East along the West line of said Mishler parcel, a distance of 141.19 feet to a 1/2 inch iron pipe marking the Southwest corner of said Mishler parcel; thence North 90 degrees 00 minutes 00 seconds West along the North line of a parcel of land conveyed to Ernest E. and Irene Chupp as described and recorded in the office of the recorder of Elkhart County in instrument number 0099-43086, being parallel with the North line of the Southwest quarter of said
Section 29, a distance of 351.01 feet to a 1/2 inch iron pipe marking the Northwest corner of said Chupp parcel, said iron pipe also being on the East line the Heritage Farms Residential planned development; thence North 00 degrees 06 minutes 46 seconds East along the East line of said Heritage Farms Residential planned development and along the East line of aforesaid Hochstetler parcel, a distance of 141.19 feet to the point of beginning of this description, containing 1.137 acres, more or less, being subject to all easements, restrictions and public rights of way of record.
    Ordinance No. 1519 will be considered on second reading at this meeting and citizens will be given the opportunity to speak during the Public Hearing.  The proposed form of the Ordinance, and any proposed fiscal plan containing the provision of services to the area proposed to be annexed, may be reviewed at the office of the City Clerk-Treasurer, 300 West Lincoln Street, Nappanee, Indiana 46550, weekdays from 8:00 a.m. to 5:00 p.m.
