NOTICE OF PUBLIC HEARING NAPPANEE BOARD OF ZONING APPEALS The City of Nappanee Board of Zoning Appeals will hold a Public Hearing Tuesday, July 10, 2012 at 6:00 p.m. in the Council Chambers of the City Municipal Building, 300 W. Lincoln St., Nappanee, Indiana. The purpose of this Hearing is to hear a variance request, #04-12-BZA, filed by Dutch Village Market, Gerald Beechy owner, 700 N. Tomahawk Trail, Nappanee, IN 46550, The request is for a variance from the Nappanee Unified Zoning and Subdivision Control Ordinance to allow an off premise 12 foot by 5 foot sign to be placed on an existing sign located at 2000 W. Market Street, Nappanee, IN 46550. The Unified Zoning and Subdivision Control Ordinance does not allow off premise signs. LEGAL DESCRIPTION OF THE PROPERTY: Commencing at a stone marking the Southeast corner of the Northwest One Quarter (NW 1/4) of Section Thirty-five (35), Township Thirty-five (35) North, Range Four (4) East; thence North zero degrees and 15 minutes West, along the East line of said Northwest Quarter 209.4 feet to a cross cut in the centerline of the pavement of U.S. Highway No. 6, the place of beginning of this description; thence continuing North zero degrees and fifteen minutes West, along the East line of said Northwest Quarter (NW 1/4) 338.4 feet to an iron stake; thence South 80 degrees and 45 minutes West, 131 .3 feet to an iron stake; thence South zero degrees and fifteen minutes East 324.95 feet to the centerline of the pavement of U.S. Highway No. 6; thence South 84 degrees and 28 minutes East, along said pavement centerline 132.0 feet to the place of beginning. Subject to any and all easements, current taxes, assessments, restriction and rights of way of record A copy of such proposal is on file in the office of the Zoning Administrator of the City of Nappanee. Written objections that are filed with the office of the Zoning Administrator of the City of Nappanee before the hearing will be considered. All concerned citizens will be offered the right to speak and voice their comment at the Public Hearing. The Public Hearing may be continued from time to time as may be found necessary.
