A Nappanee man admitted to police he has been dealing heroin when he was caught leaving drug trash in a gas station bathroom.

Arthur Crit Martin, 32, of 602 Vernon St., Nappanee, was booked in the Kosciusko County Jail at 6:46 p.m. Jan. 3 and faces charges of dealing in a narcotic drug, a Level 5 felony; possession of a narcotic drug, a Level 6 felony; possession of a syringe, a Level 6 felony; and possession of paraphernalia, a Class C misdemeanor.

According to the probable cause affidavit filed Wednesday in Kosciusko Circuit Court, on Jan. 3 Warsaw police responded to a complaint of drug trash in the men’s restroom trash can at Lassus gas station on South Buffalo Street.

When police arrived, they spoke with an employee who said she had just changed the men’s restroom trash can and discovered a blue plastic bag and a syringe in the can. The employee told police only one person had used the men’s restroom since she changed the trash bag and that person was a man who was wearing a backpack and started walking north on Buffalo Street toward downtown.

According to court papers, police located a man matching the description walking near city hall, who was identified by police as Martin. When police patted Martin down, they found a metal spoon with burn marks on the bottom, plastic bags that matched the one at the gas station, five used syringes, a package of 10 new syringes and a digital scale. One of the used syringes tested positive for heroin, the affidavit states.

The police report states that in one of the blue plastic bags there was 0.6 grams of heroin.

Martin then told police that he had heroin and had been dealing heroin to his friends, according to the affidavit.

His bond was set at $5,250.
