NOTICE OF ADOPTION OF AMENDATORY DECLARATORY RESOLUTION BY THE CITY OF NAPPANEE REDEVELOPMENT COMMISSION AMENDING THE ECONOMIC DEVELOPMENT PLAN FOR THE NAPPANEE CONSOLIDATED TIF DISTRICT TO: Citizens of the City of Nappanee, Indiana Property Owners in Economic Development Area All Other Interested Parties NOTICE IS HEREBY GIVEN that the City of Nappanee Redevelopment Commission adopted Resolution No. 2011-01 on the 11th day of January, 2011 being known as an "Amendatory Declaratory Resolution," amending the Economic Development Plan for the Nappanee Consolidated TIF District. The City of Nappanee Plan Commission on the 10th day of February, 2011 adopted a Written Order consistent with Indiana Code §36-7-14-16 approving the Amendatory Declaratory Resolution, the Amendment of the Economic Development Plan, and attachments thereto for the Nappanee Consolidated TIF District. The City of Nappanee Common Council issued its Resolution pursuant to Indiana Code §36-7-14-16 and §36-7-14-41 issuing and approving the Written Order and the Amendment of the Economic Development Plan for the Nappanee Consolidated TIF District as contemplated by said Amendatory Declaratory Resolution on the 7th day of March, 2011. The Amendatory Declaratory Resolution includes an Amendment of the Economic Development Plan for the Nappanee Consolidated TIF District. Generally stated, the Amendatory Declaratory Resolution finds that the Amendment of the Economic Development Plan is reasonable and appropriate when considered in relation to the original Economic Development Plan and the purposes of the Indiana Code §36-7-14 et seq.; that the Economic Development Plan with the proposed Amendment conforms to the Comprehensive Plan for the City of Nappanee, Indiana; and that the Amendment of the Economic Development Plan will be of public utility and benefit for the Nappanee Consolidated TIF District. The Amendatory Declaratory Resolution determines that the general boundaries of the Nappanee Consolidated TIF District will remain unchanged with any real estate to be acquired under the Amendment of the Economic Development Plan designated as part of the existing economic development project area for purposes of Indiana Code §36-7-14 et seq. Under the Amendment of the Economic Development Plan, the Commission intends to facilitate the development, redevelopment, and improvement of the Nappanee Consolidated TIF District by the acquisition and improvement of real estate within or physically connected to the Nappanee Consolidated TIF District; the elimination of vacant and/or blighted real estate; the development and installation of fiber optics; and the development of real estate for industrial park purposes. The Amendatory Declaratory Resolution estimates the cost of implementing the amendments to the Economic Development Plan to be in the sum of approximately Seven Million Three Hundred Fifty Thousand Dollars ($7,350,000.00), subject to revised costs, estimates, and the further refinement of the Economic Development Plan, as amended. Maps and plats have been prepared pertaining to the Amendatory Declaratory Resolution for the Nappanee Consolidated TIF District which can be inspected at the City of Nappanee Redevelopment Commission's office, 302 West Market St., Nappanee, Indiana 46550. The City of Nappanee Redevelopment Commission will receive and hear remonstrances and objections from persons interested in or affected by the proceedings pertaining to the amendment of the Nappanee Consolidated TIF District and will determine the public utility and benefit of the Amendatory Declaratory Resolution and Economic Development Plan, as amended. The public hearing to be conducted by the City of Nappanee Redevelopment Commission, at which time it will receive and hear remonstrances and objections and address the public utility and benefit of the proposed project, shall be on the 26th day of April, 2011 at 6:00 P.M. at the offices of the City of Nappanee Redevelopment Commission, 302 West Market St., Nappanee, Indiana. A copy of this Notice of Hearing shall be filed in the Office of the City of Nappanee Plan Commission, City of Nappanee Board of Zoning Appeals, City of Nappanee Zoning Administrator, City of Nappanee Street & Sanitation Department, City of Nappanee Board of Public Works & Safety, Nappanee Municipal Water Utility, Nappanee Wastewater Treatment Plant, City of Nappanee Park Board, City of Nappanee Common Council, City of Nappanee Clerk-Treasurer, City of Nappanee Mayor, and the City of Nappanee Building Commissioner pursuant to Indiana Code §36-7-14-17.
