GOLDEN VALLEY, Minn. - As a result of a driving while intoxicated arrest, the bail for the man accused of murdering a former Times-Union employee may be revoked.
Charles "Tony" Maddox Jr. is accused of murdering his 45-year-old wife and Shakopee Valley News reporter Ruth Anne Maddox in their Prior Lake, Minn., townhome Nov. 12, 2008. He has pleaded not guilty to the second-degree murder charges against him in Scott County, Minn.
A former Warsaw resident, Ruth Anne worked for the Times-Union from April 1, 1987, to July 8, 2003. During her tenure at the Times-Union, she covered general assignments, as well as police and courts under the bylines of Ruth Anne Lipka and Ruth Anne Long.
Tony Maddox, 47, was released on a $1 million bail.
According to a complaint filed in the Hennepin County District Court Friday, at approximately 1:10 a.m. Friday, Minnesota State Trooper Andrew Gibbs was running stationary radar on the ramp to westbound I-394 from Penn Avenue in the City of Golden Valley, Hennepin County, Minnesota, when he observed a vehicle traveling at a high rate of speed. Gibbs obtained a speed reading with his front radar on the suspect vehicle of 70 mph in the posted 55 mph speed zone.
Gibbs followed the suspect vehicle traveling westbound on I-394 and continued to obtain a speed reading of 71 mph. When the suspect vehicle continued to travel northbound on Highway 100 from I-394, it exited to westbound Highway 55 and then turned right on Douglas Drive.
Gibbs observed the suspect vehicle drive over the fog line from Highway 55 to Douglas Drive. As a result, Gibbs initiated a traffic stop of the suspect vehicle.
Upon approaching the vehicle, the driver was identified as Maddox. Gibbs smelled an odor of an alcoholic beverage coming from the vehicle. He also saw that the defendant's eyes were watery, glassy and bloodshot. The defendant also appeared nervous.
Maddox admitted to consuming three beers prior to driving. He agreed to perform field sobriety tests, but was unable to complete them successfully. In addition, the preliminary breath test revealed an "alcohol concentration of .093."
As a result, Gibbs "formed the belief that the defendant had been driving while under the influence of alcohol and placed him under arrest."
Maddox was transported to the Hennepin County Medical Center.
At approximately 1:42 a.m., Gibbs read Maddox the Minnesota Motor Vehicle Implied Consent Advisory. Maddox stated he understood the advisory and that he wanted to contact an attorney. Maddox called his attorney, and the phone call began at 1:45 a.m. to 2:18 a.m.
When asked if he would agree to provide a sample of blood for testing, Maddox stated "yes." His blood sample was obtained and submitted to the Bureau of Criminal Apprehension for testing.
A review of state records revealed the defendant was previously convicted for driving while under the influence of alcohol on Feb. 14, 2006. In addition, according to the complaint, Maddox's driver's license had been revoked for alcohol content of .10 or more on Feb. 13, 2005.
Lori Lambrecht, from the Scott County, Minn., prosecuting attorney's office, said in a telephone call this morning that Tony Maddox was still in custody in Hennepin but was supposed to be transported to Scott County Wednesday or Thursday. Maddox will have a bail hearing then because he violated at least one of the terms of his bail.
