Mentone Man Gets 2 Years For Battery On A Public Safety Official

A Mentone man was sentenced to two years in jail for head butting a jail officer and breaking his nose.
Derek Michael Bruner, 32, of 5678 W. Shilling Road, Mentone, appeared Tuesday in front of Kosciusko Superior Court II Judge Torrey Bauer and was convicted of a Level 5 felony for battery to a public safety official causing injury. Bauer sentenced Bruner two 24 months in jail, per the terms of a plea agreement. Bruner can serve his sentence through the community corrections program or home detention, if he qualifies.
The case stems from a Feb. 4 incident that took place in the Kosciusko County Jail, where Bruner was incarcerated. Bruner was throwing things and kicking a door in a cell block, so a jail officer ordered him to stop and handcuffed him and began to transport him to another area of the jail.
A second jail officer then arrived to assist, and, according to the probable cause affidavit, Bruner threatened to head butt the officer if he didn’t let him go. Bruner then did just that, breaking the officer’s nose.
In court Tuesday, Bruner’s attorney, David Kolbe, said his client has made amends with the jail officer and has even been considered to be accepted to the Jail Chemical Addiction Program (JCAP).
