Man Threatens Cop After Arrest For Driving While IntoxicatedAn Elkhart man was arrested after allegedly having a vehicle accident while intoxicated and then threatening a police officer in February.

Andrew Thomas Tokar, 27, Elkhart, was booked into the Kosciusko County Jail at 10:43 a.m. Feb. 22 on preliminary charges of leaving the scene of a crash with property damage, intimidation and operating a motor vehicle while intoxicated. He was released on his own recognizance with an initial hearing scheduled for March 14; it was rescheduled for 1 p.m. March 28.

Court documents filed Thursday list the charges against him as intimidation on a law enforcement officer, a level 6 felony, and operating a motor vehicle while intoxicated, a Class A misdemeanor.

On Feb. 22, Claypool Police Department officer Ben Sanders responded to a property damage accident. He was told by Central Dispatch that the vehicle was stuck on top of a mailbox and the driver was possibly intoxicated.

Officers saw a man – later identified as Tokar – walking down the road. Tokar admitted he was driving the vehicle involved in the accident. Officers could smell the odor of an alcoholic beverage coming from Tokar, who “had an abrasive attitude and was swearing at officers,” according to court documents.

Tokar was banging his head on the side of the patrol vehicle. He was removed and placed into Warsaw Police Department officer Clayton Rieder’s patrol vehicle cage. While Rieder was taking Tokar to the jail, Tokar said, “Wait till I come to your house. What you got kids?” and “I hope someone comes to your house and (expletive) kills you.”

Tokar refused a certified chemical test and Sanders obtained a search warrant for Tokar’s blood. Tokar was taken to Kosciusko Community Hospital, where his blood was drawn and sent to testing.

On March 6, the lab said Tokar’s blood alcohol content was .32 percent, four times the legal limit.
