Man Arrested After Allegedly Punching OfficerA Warsaw man is facing charges after he allegedly punched an officer in the chest as police were trying to medically evaluate him.
Daniel Kay Smith, 51, listed as homeless but also showing an address of 622 N. Grant St., Warsaw, was booked in the Kosciusko County Jail at 12:43 a.m. Tuesday and charged with a Level 6 battery on a law enforcement officer felony; and resisting law enforcement, a Class A misdemeanor.
According to the probable cause affidavit filed March 31 in Kosciusko Superior Court II, on Feb. 17 Syracuse police were dispatched to the area of 202 N. Main St., Syracuse, after a caller said a man had fallen in the snow and seemed to be under the influence of drugs.
When police arrived, they located the man – later identified as Smith – who was not able to form a complete sentence or stand up on his own, according to court papers.
The officer asked Smith to sit down and began to search Smith’s person for anything that could harm anyone, according to the affidavit, and Smith resisted and then struck the officer in the middle of his chest.
Smith is alleged to have further not complied with medics when they arrived to check his blood sugar and ripped off a blood pressure cuff several times before being transported to Kosciusko Community Hospital.
