A mail carrier allegedly injured in a fall on a Warsaw street is seeking compensation from the city through a lawsuit filed recently in Kosciusko Superior Court I.
According to court documents, Lon Mallory of North Webster was carrying out his duties as a mail carrier on Jan. 22, 2000, when a city of Warsaw snowplow passed the area in which Mallory was walking.
The lawsuit, filed by Warsaw attorney Joanne M. Kolbe, states that the snowplow was driven by a city of Warsaw employee "with the blade down to the road surface, quite close to the sidewalk, such that a wall of snow, slush and road debris was thrown up onto the sidewalk where (Mallory) was walking, forcing (Mallory) to the ground."
As an employee of the city, the snowplow driver "breached a duty of care" owed to Mallory as a pedestrian walking along the sidewalk and was, therefore, negligent.
Mallory is seeking an unspecified amount to compensate for "his injuries, lost wages, medical expenses and permanent impairment." He also requests a trial by jury.
