ORDINANCE NO. 2010-3 AN ORDINANCE PROHIBITING OPEN BURNING IN THE TOWN OF LEESBURG, INDIANA WHEREAS, the Town Board of the Town of Leesburg, Indiana has determined that it is in the best interest of the health and safety of the citizens of the Town of Leesburg to prohibit open burning in the Town of Leesburg. NOW, THEREFORE, BE IT ORDAINED BY THE TOWN BOARD OF THE TOWN OF LEESBURG, INDIANA AS FOLLOWS: Section 1. Open burning is hereby prohibited within the Town of Leesburg, Indiana. Section 2. This Ordinance shall not prohibit the occasional burning of charcoal, propane, natural gas, white gas, Sterno or other customary cooking fuels used in an outdoor grill or other traditional food cooking devices. Section 3. This Ordinance shall not prohibit fires used for recreational purposes, such as campfires, however no campfires are permitted within the Town limits between the hours of 6 a.m. and 6 p.m. Monday through Friday. Section 4. Any person who violates this Ordinance shall be fined in an amount of up to $25.00 for the first violation of this Ordinance and the fine shall increase in the amount of up to $25.00 for each additional violation, but not to exceed $150.00. This Ordinance shall supercede all previous Ordinances relating to open burning. This Ordinance shall be in full force and effect from and after its passage.
