A lawsuit against a former Warsaw car dealership was filed in Circuit Court recently.
The State of Indiana Attorney General's office filed a lawsuit on behalf of seven individuals concerning Quality Auto's alleged promise to deliver titles of ownership that never came to fruition.In court documents field Feb. 1, the state claims Stephen E. Schaadt, Fort Wayne, doing business as Quality Auto of Warsaw, failed to provide the title of ownership to people who purchased vehicles from the business.
The lawsuit states that Elizabeth Carpenter, no address given, was provided with an affidavit from Schaadt that stated he would deliver a title to a 2003 Dodge Stratus that Carpenter bought.
The lawsuit claims that Schaadt told six others he would deliver the title of their vehicles in a "reasonable time from date of purchase."
As of Feb. 1, none of the seven customers claimed to have received their title.
Angie Rucker, no address given, stated she traded a 1999 Ford Explorer to Quality Auto Sept. 21, 2007.
Rucker said that Micah Dilley, an employee at Quality Auto at that time, told her Quality Auto would pay off the Three Rivers Credit Union lien on the Rucker trade-in, an amount of $6,900, to which Quality Auto has not paid off.
The lawsuit claims Quality Auto violated the deceptive consumer sales act, violated delivery statute and committed other "incurable deceptive acts."
The state is seeking an injunction against Schaadt and Quality Auto of Warsaw from doing business, as well as the issuing of titles to the seven customers, payment of $6,900 to Rucker, and restitution for the office of the attorney general.
Attempts to reach Schaadt or a representative from Quality Auto were unsuccessful as the telephone number for Quality Auto listed is no longer in service.
