The Packerton Land Co. doesn't see a need to change the current contract with the county, according to district attorney Mike Armey and a letter from Sue Shadley of Plews Shadley Racher and Braun, attorneys at law.
Armey presented the communication Monday at the Kosciusko County Solid Waste District board meeting.
In addition, the district receives a rate of $1.20 to $1.50 per ton for waste coming into the landfill. A fee increase would provide more revenue for the district.
The current contract regarding the landfill, operated by Allied Waste Industries Inc., would have to be terminated, with another contract negotiated in order for the fee rate to change.
Shadley's communication, citing several court cases, indicated the county could not terminate the contract at will.
In 2000, the county and the district agreed to allow operation of a landfill and for that landfill to expand. The company provided $45,000 during the first quarter of the first year of the agreement and $15,000 per year beginning in the fourth year for truck route repairs.

Heard from Sue Mitchell that she has heard nothing from Lake City Bank regarding the sweep account, although she has left numerous messages. Nor has she heard anything from the IRS regarding the district's refund.
Heard that the shoe collection program will begin soon for the second year. Schools and other organizations will collect "old" gently used shoes, which will be distributed locally and globally.
Last year the groups were paid 25 cents per pound, by a Texas-based organization, for the 7,588 pounds collected.
Heard from executive director Sue Studebaker, who said she would prepare a mandatory report on the district's programs in 2001. It will be reviewed by the Legislative Services Agency.
Heard that a hazardous waste operator training session will be held at the KC Depot Dec. 3 with a dozen participants.
Board members include Ron Truex, Avis Gunter, George Clemens and David Delp. Ernie Wiggins, Tom Anglin and Brad Jackson were absent.
