ORDINANCE 12-02-14-004 NO TRUCKS An Ordinance establishing "No Through Semi Truck" areas on various County Roads, all within Kosciusko County, Indiana; and WHEREAS, THE BOARD OF COMMISSIONERS of the County of Kosciusko has the power to regulate the use of the public ways and rights-of ways; and WHEREAS, THE BOARD OF COMMISSIONERS has the authority to establish "No Through Semi Truck" areas on County Highways; and WHEREAS, THE COUNTY HIGHWAY Engineering Department has performed a traffic study at the aforementioned road in accordance tot he State of Indiana Uniform Traffic Control Manual and hereby recommend "No Through Semi Truck" areas be established. NOW, THEREFORE, BE IT ORDAINED by the Board of Commissioners of the County of Kosciusko as follows: 1. Establish "No Through Truck" area on CR 800 S. - between SR 15 an CR 100 W. 2. Establish "No Through Truck" area on CR 700 S. - between CR 100 W. and CR 200 W. 3. Establish "No Through Truck" area on CR 600 S - between CR 100 W and CR 200 W. 4. Establish "No Through Truck" area on Kinsey Road - between 550 S. and CR 400 S. 5. Establish "No Through Truck" area on CR 550 S. - between SR 15 and CR 400 W. 6. Establish "No Through Truck" area on CR 600 S. - between SR 15 and CR 400 W. 7. Establish "No Through Truck" area on CR 900 S. - between SR 15 and CR 200 W. 8. Establish "No Through Truck" area on CR 200 W. - between CR 900 S. and CR 550 S. 9. Establish "No Through Truck" area on CR 550 S. - between SR 15 and CR 200 W. The County Sheriff's Department shall enforce this Ordinance. Any duly qualified and acting law enforcement officer serving in the County may enforce this Ordinance. Arrests and court appearances under this Ordinance shall be in accordance with Indiana Code 34-28-5. Ordinance violation proceeding shall be in accordance with Indiana Code 33-36-2. No part of this Ordinance shall be deemed to conflict with any State law. Any conflict which does exist shall, so far as possible, be resolved under the statutory presumptions in Title 36 of the Indiana Code. A person who violates any provisions of this Ordinance commits an ordinance violation. Any person who violates this Ordinance shall be fined or have a judgment entered against the person in an amount not to exceed $500.00. Any resident or business along the segment of roads in the ordinance are exempt. THIS ORDINANCE shall be in full force and effect on February 14, 2012 and stay in effect until the completion of SR 15 and CR 700 S road closure.
