NOTICE OF PUBLIC HEARING STATE OF INDIANA KOSCIUSKO COUNTY SS: BEFORE THE BOARD OF COMMISSIONERS OF KOSCIUSKO COUNTY IN RE: THE PETITION OF BENNY J. SALSBERY AND CATHERINE S. SALSBERY TO THE CITIZENS OF KOSCIUSKO COUNTY, INDIANA You are hereby notified that a petition has been filed with the Board of Commissioners of Kosciusko County, Indiana by Benny J. Salsbery and Catherine S. Salsbery requesting the vacation by ordinance of a part of a "Drive" in the Plat of Roy Hohman Subdivision on Yellow Creek Lake, Kosciusko County, Indiana, and which "Drive" is described as follows: Part of a platted drive in the Roy Hohman Subdivision on Yellow Creek Lake, Kosciusko County, Indiana, more particularly described as follows, to wit: Beginning at a P.K. nail found at the Southwest corner of Lot Number 20 in said Roy Hohman Subdivision; thence S88°-37'-00"E (the basis of bearings for this description is an assumed bearing of N90º-00'-00"E for the North line of Lots Numbered 18 and 19 in said Roy Hohman Subdivision), on and along the South line of said Lot Number 20, a distance of 54.35 feet (recorded 55 feet), to a P.K. nail found at the Southeast corner of said Lot Number 20; thence S02°-00'-00"W, on and along the Southerly projection of the East line of said Lot Number 20, a distance of 42.00 feet to the point of intersection with the water's edge of Yellow Creek Lake, said point being situated S02°-00'-00"W, a distance of 6.5 feet from a 5/8-inch iron pin capped "Walker" found; thence S87°-08'-00"W, on and along said water's edge, a distance of 54.00 feet to the point of intersection with the Southerly projection of the West line of said Lot Number 20, said point being situated S01°-17'-00"W, a distance of 3.0 feet from a 5/8-inch iron pin capped "Walker"; thence N01°-17'-00"E, on and along said Southerly projection, a distance of 46.00 feet to the point of beginning, containing 0.055 acres of land, more or less, subject to all legal right-of-way, subject to all legal drain easements and subject to all other easements of record. You are hereby notified that the Board of Commissioners of Kosciusko County, Indiana has set the above petition for hearing at 9:15 a.m., on March 15, 2011, at the Kosciusko County Board of Commissioners Meeting Room in the Kosciusko County Courthouse, 100 West Center Street, Warsaw, Indiana 46580. Any person may appear and be heard upon the petition at the time, date and place above scheduled for hearing and/or may send written comments or response to the Auditor of Kosciusko County, Indiana, prior to the above time and date set for hearing. After hearing, the petition may be granted, denied or continued, and an ordinance may be introduced and passed according to law, providing for the vacation of said real estate. Additionally, please be notified that the Petitioner has tendered a Deed of Dedication for the pavement area of the Drive as it is actually and currently utilized, in order to retain the existing drive-way in the location where it has been historically used by the neighborhood.
