The Kosciusko County Area Plan Commission will conduct a hearing on an application filed by Lakeview Spring Partners LLC, to eliminate the following restrictive covenants placed on the below described real estate through cases 8514Z, 8701A & 07001PA; Amended Restrictive Covenants Approved on April 4, 2007 1. The property shall be used for retail sales only, no auctions shall be conducted on the property. 2. The only items that will be allowed for outdoor display are 14 Recreational Vehicles. These R.V.'s must be in good attractive and saleable condition and will displayed only in the ·area as shown on the site plan dated April 4, 2007 ~ submitted to the Area Plan Commission by the petitioners attorney and labeled in red as "Allen Site Plan, April 4, 2007". 3. Customer parking areas shall be limited to those designated on "Allen Site Plan, April 4, 2007". 4. Decorative fencing and landscaping shall be installed along the North and East sides of the real estate as shown on "Allen Site Plan, April 4, 2007" which eliminate the current accesses to the site. 5. The sole entrance / exit to the property shall be off County Road 400 N and shall be at the far western edge of the property. 6. A detailed and drawn to scale site plan of the proposed operations shall be prepared and submitted to the Area Plan Commission Office. Prior to the issuance of any Improvement Location Permits or Occupancy Permits, this plan must be approved by the Area Plan Commission Director for compliance with the five prior listed restrictive covenants. The Kosciusko County Area Plan Commission will conduct a hearing on an application filed by Lakeview Spring Partners LLC, to eliminate the following restrictive covenants placed on the below described real estate through cases 8514Z, 8701A, & 07001PA; Part of the Northwest Quarter of Section 26, Township 33 North, Range 7 East, more particularly described as follows: A tract of land in the Northwest Quarter of Section 26, Township 33 North, Range 7 East, in Kosciusko County, Indiana beginning at an iron bolt marking the Northwest corner of said Section and running thence South 20 1 feet on the Section line to a concrete post; thence East 414 feet to an iron pipe on the West right of way line of State Road 13; thence North 35 degrees West along said right of way line 195.3 feet to a concrete right of way marker; thence Northwesterly 47.8 feet to a concrete right of way marker; thence North 22.5 feet to a railroad spike on the North section line, thence West on said Section line 260.3 feet to the place of-beginning Otherwise known as 8041 E 400 N Leesburg Key #005-102-00.5. The Hearing will be held on November 6, 2013 at 1:00 p.m. in the Commissioners Meeting Room on the 3rd floor of the Courthouse, Warsaw Indiana 46580.
