NOTICE OF PUBLIC HEARING Notice is hereby given, that the Kosciusko County Area Plan Commission shall hold a public hearing on a petition filed by Carey Realty Co. Inc. requesting the vacation of a Plat North Warsaw Industrial Center Lots 1-8 located on the east side of State Road 15 in Plain Township, Kosciusko County, Indiana. The property being situated in the Plat of Warsaw Industrial Center, Kosciusko County, Indiana and described as follows: Part of the southeast quarter of section 17, township 33 north, range 6 east, Kosciusko County, Indiana, more particularly described as follows, to wit: Commencing at a PK nail at the southwest corner of said southeast quarter, thence N89º-20'45"E (basis of bearings for this description is an assumed bearing of N00º-00'E for the east line of said southeast quarter), on and along the south line of said southeast quarter, a distance of 63.4 feet to the point of intersection with the east right-of-way line of the Winona Interurban Railway, thence N00º-03'42"E, on and along said East right-of-way, a distance of 1640.75 feet to an iron pin found at the true point of beginning; thence continuing N00º-03'042"E, on and along said east right-of-way line, a distance of 1063.15 feet to an iron pin at the point of intersection with the north line of said southeast quarter thence S89º-43'E, on and along said north line, a distance of 695.41 feet to an iron pin, said iron pin being situated N89º43'W, a distance of 1885.71 feet (recorded 114 2/7 rods which equals 1885.1 feet) from a railroad spike found at the northeast corner of said southeast quarter, thence S00º-00'W, parallel to the east line of said southeast quarter, a distance of 1155.0 feet to an iron pin; thence N89º-43'W,, parallel to said north line, a distance of 296.11 feet to an iron pin; thence N00º-03"-42'E, parallel to said east right-of-way line, a distance of 88.28 feet to an iron pin found; thence N89º-12'23" W, a distance of 400.58 feet to the true point of beginning, containing 17.628 acres of land, more or less, subject to all legal right-of-way, subject to all legal drain easements and all other easements of record. This hearing will be held at Commissioners Room on the 3rd floor of the Kosciusko County Courthouse, Warsaw, Indiana, on Wednesday, the 4th day of August, 2010 at 1:00 p.m. All interested persons are invited to attend and be heard. Written comments will be considered if they are received in the Office of the Area Planning Department no later than 12:00 Noon on the day of the hearing.
