Kosciusko County prosecutor David Kolbe said he has not received a formal report on polling-place visits by a candidate on primary election day.
Charles Waggoner, Republican nominee for county prosecutor, admitted visiting seven polling places to thank the poll workers but said he did not speak to voters during the election. The visits allegedly violated election laws that say a candidate must stay 50 feet away from the polls.
If he does receive a report, Kolbe said, he will have to appoint a special prosecutor to investigate if he feels the case warrants investigation. Kolbe will have to ask for a special prosecutor since he was also a candidate in the primary election. But, Kolbe said, it is his discretion to decide if the charges are serious enough to pursue.
Kolbe said his office did receive a challenge affidavit of a voter, alleging a voter was not a resident of Kosciusko County at the time of the election. Kolbe said he will ask a special prosecutor to look over the allegations.
