WARSAW - A federal judge has reduced to $33.8 million a jury's damage award against Biomet Inc. for allegedly stealing the design for an artificial hip socket, the company said Wednesday.
U.S. District Judge Daniel T.K. Hurley of the Southern District of Florida made the ruling Tuesday after the jury last January awarded compensatory and punitive damages of $55 million.
The jury found that the Warsaw-based orthopedics company used Dr. Raymond Tronzo's patented acetabular cup, a key component in hip replacement systems, in its own Mallory-Head cup.
Biomet maintains another doctor designed the cup and said it began selling the cup in 1985, three years before Tronzo's patent.
