An injunction granted in Kosciusko Circuit Court Tuesday afternoon will temporarily close the doors of a Warsaw business.
Dating Dynamics & Massage Inc. of Warsaw has been operating without the permits required to satisfy a city ordinance since October 2005.
Tuesday afternoon, Jeanetta Fairchild appeared in court without an attorney, but admitted she had been operating Dating Dynamics without the permit for more than a year.
Before Kosciusko Circuit Court Judge Rex Reed made his decision, Fairchild said, "I would like to say that I did nothing intentionally to defy the city. ... I tried to make sure I ran a legit business and always have. ... (The business) is how I take care of my family. ... If I offend them or God by having it, I apologize."
Fairchild said in court that she had been operating the massage establishment without the permit since October 2005.
"I don't care what the city likes or does not like," Judge Reed said. "... The evidence is rather clear that Dating Dynamics & Massage Inc. and Jeanetta Fairchild did not have the proper permit to operate a massage parlor in Warsaw."
According to testimony from Warsaw Police Department Detective Tony Faucett, in June he inspected Dating Dynamics and gave Fairchild a written notice of violations of the city ordinance regarding massage establishments.
According to the ordinance, a business owner has 10 days from the date of the violations to request (in writing) a hearing about the violations.
Faucett said no request for a hearing was received until July, after the 10-day limit, so the business's operating permit was revoked.
After the permit was revoked, Faucett said he visited the establishment at least 15 to 20 times, and each time the business was in operation.
A hearing will be held at a later date to determine if a permanent injunction will be granted in the case.
