LEGAL NOTICE STATE OF INDIANA INDIANA UTILITY REGULATORY COMMISSION VERIFIED PETITION OF NORTHERN INDIANA PUBLIC SERVICE COMPANY REQUESTING THE INDIANA UTILITY REGULATORY COMMISSION TO APPROVE AN ALTERNATIVE REGULATORY PLAN PURSUANT TO IND. CODE § 8-1-2.5-1, ET SEQ., FOR THE OFFERING OF ENERGY EFFICIENCY CONSERVATION, DEMAND RESPONSE AND DEMAND-SIDE MANAGEMENT PROGRAMS AND ASSOCIATED RATE TREATMENT INCLUDING INCENTIVES IN ACCORDANCE WITH IND. AND 8-1-2-42(a); AUTHORITY TO DEFER PROGRAM COSTS ASSOCIATED WITH ITS AUTOMATED METER PROGRAM; AUTHORITY TO IMPLEMENT NEW AND ENHANCED ENERGY PROGRAMS; AUTHORITY TO IMPLEMENT AN FAC ALLOCATOR MECHANISM APPLICABLE TO THE FUEL COST ADJUSTMENT CLAUSE MECHANISM; AND APPROVAL OF MODIFICATION OF THE FUEL ADJUSTMENT CLAUSE EARNINGS AND EXPENSE TESTS. CAUSE NO. 43618 Notice is hereby given that on December 4, 2008, Northern Indiana Public Service Company ("Petitioner," "NIPSCO," or "Company") pursuant to Ind. Code § 8-1-2.5-1, petitioned the Indiana Utility Regulatory Commission in Cause No. 43618 for approval of an alternative regulatory plan for the offering of energy efficiency conservation, demand response and demand-side management programs and associated rate treatment including incentives in accordance with Ind. Code §§ 8-1-2.5-1 et seq. and 8-1-2-42(a); authority to defer costs associated with its Automated Meter Program; authority to implement new and enhanced energy programs; authority to implement an Fuel Adjustment Clause ("FAC") allocators mechanism applicable to the fuel cost adjustment clause mechanism; and approval of modification of the FAC earnings and expense tests.
