NOTICE OF INTENT December 27, 2010 Indiana Housing and Community Development Authority 30 South Meridian Street, Suite 1000 Indianapolis, Indiana 46204 317-232-7777 On or about January 17, 2011 Indiana Housing and Community Development Authority (IHCDA) will issue contracts regarding the expenditure of Community Development Block Grant funds under Title I of the Housing and Community Development Act of 1974, as amended, granted to the agency by the US Department of Housing and Urban Development (HUD) to undertake a project known as: Project title: Weatherization for Shelters Purpose/Scope of project: minor structural repairs of buildings used as shelters, in order to facilitate weatherization activities as part of the Home Energy Conservation Program Estimated funding: $3-6 million Project location if applicable: 41 shelters within the following counties: Allen, Tippecanoe, Vanderburgh, St. Joseph, Floyd, Porter, Ripley, Green, Marion, Jasper, Monroe, Kosciusko, Whitley, Dearborn, Hancock, Elkhart, Lake, Grant, Howard, Montgomery, Vigo, Morgan, Delaware, Jackson. The activities proposed are categorically excluded under HUD regulations at 24 CFR Part 58 for National Environmental Policy Act (NEPA) requirements. An Environmental Review Record (ERR) that documents the environmental determinations for this project is on file at Indiana Housing and Community Development Authority offices where ERR can be examined or copied weekdays 8:30 A.M. to 5:00 P.M. PUBLIC COMMENTS Any individual, group, or agency may submit written comments on the ERR to Indiana Housing and Community Development Authority's Environmental Officer. All comments received by January 14, 2011 will be considered by the Indiana Housing and Community Development Authority, prior to authorizing use of funds RELEASE OF FUNDS The Indiana Housing and Community Development Authority certifies that Sherry Seiwert, in her capacity as Executive Director consents to accept the jurisdiction of the Federal Courts if an action is brought to enforce responsibilities in relation to the environmental review process and that these responsibilities have been satisfied. IHCDA's approval of the certification satisfies its responsibilities under NEPA and related laws and authorities, and allows them to use Program funds. OBJECTIONS TO RELEASE OF FUNDS IHCDA will accept objections to its release of funds and the certification for a period of fifteen days following the anticipated submission date or its actual receipt of the request (whichever is later) only if they are on one of the following bases: (a) the certification was not executed by the Certifying Officer (b) has omitted a step or failed to make a decision or finding required by HUD regulations at 24 CFR Part 58; (c) has committed funds or incurred costs not authorized by 24 CFR Part 58 before approval of a release of funds; or (d) another Federal agency acting pursuant to 40 CFR Part 1504 has submitted a written finding that the project is unsatisfactory from the standpoint of environmental quality.
