Hearing Officer Lawrence Clifford Monday reviewed two properties that the city has named unsafe.
Lawrence reviewed a vacant two-story commercial building at 202 S. Union St. that has been deemed unsafe and in poor condition.A letter was written to Donald and Cheryl Doan, 12612 Beech Road, Bourbon, who currently own the property. The letter was dated May 14 from the Warsaw Building and Planning Department and stated the building needs to be demolished.
Warsaw Building Commissioner Todd Slabaugh said the building has broken windows and cracked brick.
He said a man who makes furniture approached him about his interest in purchasing the property and using the location to make furniture. Slabaugh met with the man a few weeks ago to show him what needed to be done to bring the building up to city code.
Clifford put a demolition order for the building in place, but postponed it until a hearing Aug. 17.
The other unsafe property Clifford reviewed was a three-unit condominium at 212-222 N. McKinley St.
The building and planning department sent out a letter dated May 14 to Kim Edmonds, who is the original contractor for the building.
Letters also were sent to Steven Petty, 818 E. Fort Wayne St., who purchased two of the condos that are currently vacant, and Evelyn Lowman, 212 N. McKinley St., who purchased one of the condos and currently lives in it.
The letter states the sewer lateral was improperly sized and was not inspected. It also states the lateral needs to be replaced with the proper size and inspected. Final grading and seeding of the property needs to be completed.
The letter stated the temporary certificate of occupancy has expired, and all of the items need to be completed before a full certificate of occupancy can be granted.
Clifford imposed a civil penalty against Edmonds for $2,500 for his willful failure to make repairs to the unsafe premise.
The case will be heard again at an Aug. 17 hearing.
