Kosciusko County Health Department has filed a complaint against the owner and unknown occupants of a property in Warsaw.
The property, 3915 W. Old U.S. 30, Warsaw, is owned by Mary Coffey.
According to the complaint, on Aug. 7, 2024, the health department issued a cease and desist order for insanitary disposal at the property, which ordered Coffey/the residents to remove a tent from the property on or before Aug. 7, 2024. The tent was not removed.
The order also informed the defendants they were in violation of a Kosciusko County ordinance due to insanitary disposal of sewage material occurring at the property, specifically open sewage on the ground surface.
Kosciusko County Ordinance 16-1-13(b)(2) states, “No person shall place, deposit or permit to be deposited, any human excrement or sewage in an unsanitary manner within the county.”
The ordinance says individuals in violation of the ordinance “shall be fined not more than $500 for the first violation, (and) $1,000 for the second and each different violation.”
“As a result, the health and safety of the defendants and/or occupants may be at risk due to the insanitary conditions of the property,” according to the lawsuit.
The health department is requesting an order from the Kosciusko County courts requiring compliance with the ordinances, as well as an entry of fines against Coffey and the property’s occupants, and coverage of court costs.
