A grand jury will meet Nov. 19 and 20 to decide, among other cases, whether or not former Kosciusko County Solid Waste District director Marsha Eikenberry will be indicted, according to county prosecutor Chuck Waggoner.
"A letter from State Examiner Charles Johnson III, CPA, indicates the Eikenberry report was delivered to me for delivery to the grand jury of Kosciusko County," Waggoner said today.
The State Board of Accounts report was filed Oct. 19 and shows Eikenberry misappropriated $18,568.03 in various ways while she was the Solid Waste District director. She also must reimburse the state and the Solid Waste District an additional $6,268.42 for the report's preparation.
The report said she acted alone during her time as director, from Jan. 1, 1999, until March 16, 2001.
A grand jury finds probable cause that an offense was committed and indicates the person suspected of committing that offense.
"In public integrity cases citizens make the decision, rather than just the prosecutor," Waggoner said. Usually a judge decides these issues, based on the prosecutor's fact-finding. "Citizens decide as part of the openness of government because they'll be looking at the books of the government.
"A public airing is part of the process when it comes to the public integrity process."
