Fort Wayne Man Gets 2-1/2 Years In Jail For Possession Of Child PornThe Fort Wayne man who printed off child pornography at the Warsaw Walmart last summer was sentenced to 2-1/2 years in jail Thursday.
Brendan D. Chivington, 26, Fort Wayne, appeared Thursday in front of Kosciusko Superior Court I Judge David Cates and was convicted of possession of child pornography, a Level 6 felony. A Level 5 felony charge of child exploitation was dropped because prosecutors said in order to charge him with exploitation Level 5, Chivington would have had to have transferred the pornographic images from his device to another person’s device, which Chivington did not do.
Cates sentenced Chivington to serve 2-1/2 years in the Kosciusko County Jail, with 1-1/2 years suspended to formal probation. Chivington will have to register as a sex offender for 10 years and comply with treatment recommendations from the Bowen Center.
According to the probable cause affidavit in the case, on Sept. 4, Warsaw Walmart employees were reviewing the photography system and observed that on Aug. 28 child pornography had been printed off.
Chivington was identified by police after Warsaw police posted surveillance footage to crimenet.com and the Whitley County Probation Department advised the man was Chivington.
In court Thursday, Kosciusko County Chief Prosecuting Attorney Brad Voelz said the court should take child pornography cases seriously because it’s a problem not only in this county, but nationwide. Voelz also said that consumers of child pornography, like Chivington, help create a market for the problem. Voelz also noted that the images Chivington had in his possession were ones he downloaded from the internet, not photos Chivington took or of any children Chivington knew.
Austin Rovenstine, Chivington’s attorney, told the judge, “His actions were wrong, stupid and embarrassing.”
When asked for a statement, Chivington said, “Everyone here said it. Embarrassing and for the next 10 years, I will remember it.”
“I have yet to see any evidence that you are remorseful,” Cates said. “Including what you just told me. That impact’s on you. No. The impact is on these kids being exploited and abused and you’re creating a market. You have shown no remorse. I hope you can address the issues that brought you to this point.”
