Former Warsaw Police Department patrolman Timothy S. Whitright turned himself in, then bonded out Friday evening on charges of child molestation and child solicitation.
According to a probable cause affidavit filed in Kosciusko County Superior Court 1 Friday, Whitright is alleged to have solicited a girl, under 14 years old, for sexual contact.
Whitright, 28, of 4080 N. CR 375E, Warsaw, was booked into Kosciusko County Jail at 5:40 p.m. Friday on a count of child molesting, a class C felony, and child solicitation, a class D felony. His bond was set at $10,000 and he bonded out Friday evening.
According to the probable cause affidavit, the girl was at the Whitright home with friends and later was given a ride home by Whitright.
During the ride home, Whitright allegedly attempted to solicit sexual favors from the girl, and the girl alleged he touched her in her private area.
The girl told investigators that Whitright told her not to tell anyone and that nobody would believe her because “he’s a cop and (she) was a kid.”
During an interview with investigators, according to the probable cause affidavit, Whitright admitted to asking for sexual contact with the girl and placing his hand on her waist/stomach area and just inside the waistband of her pants, however, Whitright denied that he reach any further into her pants.
Whitright resigned from the Warsaw Police Department in November after he was accused of sending lewd texts and kissing a 16-year-old Warsaw Community High School student he met at the school while on duty in early November.
That incident was reported to Warsaw Police Chief Scott Whittaker Nov. 18.
While the girl was 16, the age of consent in Indiana, Indiana state laws did leave Whitright open to criminal prosecution.
Some Indiana laws are written so that anyone over 18 soliciting someone under 18 in certain ways can face criminal charges. At the time of Whitright’s allegations, the prosecutor’s office did say it would launch an investigation into Whitright.
The Times-Union was unable to contact anyone from the prosecutor’s office to ascertain whether these charges were a result of the investigation or were found independently.
It’s also unclear whether the Warsaw Police Department was aware of the newest allegation against Whitright.
