Any eating establishment that sells alcoholic beverages must have enough of the minimum food requirements at all times to serve 25 people.
Those requirements include hot soup, hot sandwiches, coffee, milk and soft drinks. Pizza may be substituted for the sandwiches.
"You have to look at it as being a restaurant (first)," Indiana excise officer Patty Fleck said Thursday at the Kosciusko County Alcoholic Beverage Commission meeting.
Fleck told the Mentone Tavern, 103 Main St., Mentone, that on her last visit, they didn't have enough milk. If she stops in again and they don't have enough milk, she will cite them for a violation.
Mentone Tavern was at the meeting for a transfer of ownership of its beer and wine and Sunday sales retailer permits. The transfer was unanimously approved by the commission.
Also approved was Raceway Steakhouse's renewal.
Raceway Steakhouse, Ind. 13, Pierceton, has had its beer and wine and Sunday sales retailer permits in and out of escrow during the past year. At the ABC meeting in May, Fleck told business owner James Ousley if the business is not up and running before June 6, the permit will not be renewed. She said if Ousley can't make use of the permit, another business could. She continued the renewal for the petition to Thursday's meeting. The business is now in operation.

Kmart, Warsaw, beer and wine dealer renewal.
South Shore Golf Club, Syracuse, beer, wine and liquor and Sunday sales retailer renewals.
Ramada Plaza Hotel, Warsaw, beer, wine and liquor and Sunday sales retailer renewals.
Liquor Locker, Syracuse, beer, wine and liquor dealer renewal.
Fleck also said any business, establishment or person wanting to obtain an alcohol beverage license needs to call the Alcohol and Tobacco Commission for the application for a permit. The phone number is 317-232-2460. Anyone with further questions regarding alcohol permits should contact the district excise office in Roanoke at 260-672-8946 instead of the ABC members.
Members of the commission are chairman Darwin Call, Gordon Vanator, Kenneth Johnson and Fleck. Because of the July 4 holiday, the commission will meet at 1 p.m. July 3 in the county courthouse instead of on July 4.
