RESOLUTION 2013-5 WHEREAS, the town council for the Town of Etna Green, Indiana, has the power to establish a cumulative capital development fund under Indiana Code 36-9-15.5-1 et. seq; and WHEREAS, in order to provide funds for purposes as allowed under Indiana Code 36-9-15.5-2, the Town now does believe that it is appropriate to establish such a fund, as provided for under Indiana Code 6-1.1-41-3; It is NOW RESOLVED by the Town of Etna Green that: 1. It is the intent of the Town of Etna Green to establish a Cumulative Capital Development Fund under I.C. 36-9-15.5-1 et. seq. 2. The Clerk Treasurer of the Town of Etna Green is hereby directed to give notice of this proposal to all affected tax payers in accordance with Indiana Code 6-1.1-41-3, and Indiana Code 5-3-1. 3. The tax levy to be imposed by the fund is at the rate of .05 as allowable under I.C. 36-9-15.5-6. 4. Public hearing shall be held on this proposal prior to submitting this proposal to the Department of Local Government Finance for Approval, which hearing shall be conducted at the Town Offices, located at the Etna Green Fire Department, on April 9, 2013 at 7 a.m. 5. At that public hearing, the Town of Etna Green, Indiana, if it adopts a proposal for establishing such a Cumulative Capital Development Fund, shall present the proposal to the Department of Local Government Finance for approval before said fund is established.
