NOTICE OF ENFORCEMENT AUTHORITY ORDER TO ORVILLE SPEARS, TEALIE SPEARS AND ALSO TO ANY AND ALL OWNERS OR HOLDERS OF ANY INTEREST IN REAL PROPERTY COMMONLY KNOWN AS 2215 EAST 800 SOUTH, CLAYPOOL, IN 46510 STATE OF INDIANA ss: COUNTY OF KOSCIUSKO Pursuant to Indiana Code 36-7-9-1 et seq., as adopted by Kosciusko County Ordinance 11-11-22-001, Orville Spears and Tealie Spears were ordered on December 8, 2015 to demolish and remove the unsafe building located on real property situate in Kosciusko County, Indiana, which real property is commonly known as 2215 East 800 South, Claypool, Indiana 46510, and legally described as follows: TRACT I: Beginning at a point 508.725 feet West of the East line of the Northwest Fractional Quarter of Section 30, Township 31 North, Range 7 East, on the South line of the East-West public highway running between Jackson and Monroe Townships and running thence West 60 feet on the South line of said public highway; thence South 120 feet; thence East 60 feet; and thence North 120 feet to the Place of Beginning. TRACT II: Beginning at a point 568.725 feet West of the East line of the Northwest Fractional Quarter of Section 30, Township 31 North, Range 7 East, on the South line of the East-West public highway running between Jackson and Monroe Townships and running thence West 60 feet on the South line of said public highway; thence South 120 feet; thence East 60 feet; and thence North 120 feet, to the Place of Beginning. That the said order was affirmed by the Hearing Authority on February 1, 2016, but that the order was not complied with, and that, accordingly, a contract is to be let at public bid to a contractor with all necessary licensing and legal qualifications and who is bonded to accomplish work to comply with the order. That the work to be the demolition and removal of the unsafe building located at 2215 E. 800 South, Claypool, Indiana 46510, including pumping and filling of any septic tank and/or drywell and grading and seeding, but excluding removal of concrete slab foundations. All garbage and debris must be removed from the premises Both the bid price of the contractor who accomplishes the work and an amount representing a reasonable estimate of the cost incurred by the enforcement authority in processing the matter of the unsafe premises may, if not paid, be recorded after a hearing as a lien against all persons having a fee interest, life estate interest, or equitable interest of a contract purchaser in the unsafe premises. Sealed bids will be received by the Kosciusko County Health Department, at 100 West Center Street, Warsaw, Indiana 46580 until 1:30 PM prevailing local time on the 23rd day of June, 2016. All bids will then be publicly opened and read aloud in the Kosciusko County Courthouse at 100 West Center Street, Indiana 46580, on the 23rd day of June, 2016, at 1:30 PM, in the Old Courtroom located on the Second Floor.
